The confidentiality of a surrogate mother is so crucial that it is protected by law. The tranquility and medical privacy of the participants in the surrogacy program are safeguarded by three articles of the Fundamental Legislation of Ukraine on Health Protection. The Civil Code of Ukraine establishes the right to privacy regarding the state of health (Article 286). Additionally, the Constitution of Ukraine and a number of international documents regulate issues of medical ethics, respect for human dignity, and the right to personal life.
The obligation of all participants in the program is to observe complete confidentiality. According to the International Code of Medical Ethics (1949), it is the duty of a doctor to keep all information about the patient confidential. The same is stated in the Declaration on the Provision of Patient Rights in Europe for the year 1994.
The prohibition on discussing medical confidentiality applies not only to doctors but also to all clinic staff and even your neighbors. The dissemination of any information related to your health, diagnosis, or the fact of seeking medical care is prohibited.
Confidential information is divided into two types: medical (information about the patient’s health) and non-medical (information about their intimate and family life).

There are some aspects that make surrogacy better than traditional adoption:
The waiting time is much shorter. The process of adoption can often take the incompetent couples many years. When the surrogate conceives the waiting period is only nine months;
sometimes the prospective parents discover that they are infertile too late and cannot be accepted by an adoption agency because of they are too old;
the intended parents have the genetic relation to the child.
Very often, the issue of surrogate motherhood brings up several ethical questions, and the most common one is who has parental rights if the surrogate changes her mind to give the baby away?
The controversy appears when the carrier wants to keep the baby, especially if she is the child’s biological mother. If the intended parents and the surrogate mother signed the contract the couple has legal parental right to the child. If the agreement between them was of private character the intended parents may not have the possibility to prove that the surrogate carries their baby and the whole situation will be on her conscience.
Of course, there are medical, moral and psychological challengers in the process of surrogate motherhood. But their gradual solution and overcoming is a natural way of entering into our daily life of the new technologies, which – at the global level – help humanity to exist, and at private level – to be parents who have the happiness to keep on hands a long-awaited and favorite child.
🔷Traditional surrogacy
Traditional surrogacy involves artificially inseminating a surrogate mother with the intended father’s s***m via IUI, IVF or home insemination. With this method, the child is genetically related to its father and the surrogate mother.
🔷Traditional surrogacy and donor s***m
A surrogate mother is artificially inseminated with donor s***m via IUI, IVF or home insemination. The child born is genetically related to the s***m donor and the surrogate mother.
🔷Gestational surrogacy
Gestational surrogacy is when the intended mother is not able to carry a baby to term due to hysterectomy, diabetes, cancer, etc., her egg and the intended father’s s***m are used to create an embryo (via IVF) that is transferred into and carried by the surrogate mother. The resulting child is genetically related to its parents while the surrogate mother has no genetic relation.
🔷Gestational surrogacy and egg donation
This type is used if there is no intended mother or the intended mother is unable to produce eggs, the surrogate mother carries the embryo developed from a donor egg that has been fertilized by s***m from the intended father. With this method, the child born is genetically related to the intended father and the surrogate mother has no genetic relation.
🔷Gestational surrogacy and donor s***m
If there is no intended father or the intended father is unable to produce s***m, the surrogate mother carries an embryo developed from the intended mother’s egg (who is unable to carry a pregnancy herself) and donor s***m. With this method, the child born is genetically related to the intended mother and the surrogate mother has no genetic relation.
🔷Gestational surrogacy and donor embryo
When the intended parents are unable to produce either s***m, egg, or embryo, the surrogate mother can carry a donated embryo (often from other couples who have completed IVF that have leftover embryos). The child born is genetically related neither to the intended parents nor the surrogate mother.

Ukrainian women are fleeing war, but interest in surrogate motherhood persists in the country. Clinics attract foreign women
Before the war, Ukraine was talked about as the center of world surrogacy. Surrogacy is legal in the country and has been widely used by couples abroad. The interest is not abating even now, but many Ukrainian women fled the country before the horrors of the war. That is also why clinics are now turning to foreign women, mainly from post-Soviet countries but also from East Asia, with the offer of maternity for a bribe. ČT reporter Darja Stomatova mapped the situation surrounding surrogacy in Ukraine.
Surrogate mother Olga has already given birth to two infertile couples from Germany. He wants to solve his difficult life situation with the money he earns. "I broke up with my boyfriend. I was left alone with two children without my own home, so I wanted to buy an apartment so I wouldn't be dependent on anyone," she explains her motivations.

Business was significantly affected by the departure of Ukrainian women abroad. "We already offer them $26,000 or $27,000, but all clinics still face shortages. On the other hand, we started placing advertisements and surrogate mothers from all over the world are contacting us," says company owner Albert Tochilovskij.
The legality of surrogacy does not appeal to a part of Ukrainian parliamentarians who call for a ban or restriction of this practice. One of their arguments is the demographic crisis associated with the war. The birth rate in the country decreased by a quarter last year. "There won't be enough brides for men, but we also have a lot of losses in the war, so we can't estimate the gender proportions now," noted expert Svetlana Aksjonova from the Institute of Demography and Social Research.
Ukraine controls almost a quarter of the world market in surrogacy, despite its population being less than one per cent. It means a significant source of foreign currency for the country. "Perhaps this will sound too bold. "Surrogate mothers from abroad could become the driving force of the Ukrainian economy," believes Tochilovsky.
The company now deals with the legal issue of mothers from abroad, so Ukrainian women still predominate. Some surrogate mothers are still in contact with foreign parents. "If you could see the tenderness with which parents take their children in their arms. There are so many emotions, and tears. And you understand that you contributed a little to it. Moreover, a woman with an average salary does not earn that much in Ukraine," noted Olga.
She herself decided to become a surrogate mother for the third time to pay off the remaining debts. In many cases, the Ukrainian legislation no longer allows this.
