According to a new report from CBS News, "[t]he manufacturer behind now-recalled cinnamon applesauce pouches failed to ever test its product for heavy metals, the Food and Drug Administration found in a recent inspection, among several shortfalls by the plant now linked to hundreds of lead poisonings nationwide."

Factory never tested applesauce packets that were recalled due to lead poisonings, FDA finds FDA testing found "extremely high levels of lead contamination" in the cinnamon applesauce pouches, which have been recalled.

Dreyer Boyajian LLP is pleased to share that Federal district court Judge David N. Hurd of the Northern District of New York has granted final approval of a $6.5 million dollar settlement in a class-action lawsuit filed against Rensselaer Polytechnic Institute (“RPI”).

The lawsuit alleged that students enrolled at RPI’s Troy, New York campus failed to receive the benefit of an in-person, on-campus educational experience after RPI transitioned to remote learning in response to the COVID-19 pandemic and sought a refund of certain tuition and fees.

The class settlement includes all eligible persons who were enrolled at RPI during the Spring 2020 and Summer Arch 2020 semesters. Class members were previously provided notice of the settlement, which was granted preliminary approval by the court on August 25, 2023.

Donald Boyajian and James Peluso, who represented the plaintiffs, said that “This tuition refund litigation was the first-of-its kind, and we are pleased that the RPI settlement represents one of the highest per student awards in the nation.”

The FDA has posted an update to its investigation into lead contamination in WanaBana's Cinnamon Applesauce pouches: "the sample of recalled WanaBana cinnamon apple puree pouch collected from Dollar Tree had a lead concentration of 2.18 ppm which, for context, is more than 200 times greater than the action level of 0.01 ppm that the FDA has proposed in draft guidance for fruit purees and similar products intended for babies and young children."

According to the FDA, NYS saw more complaints of elevated lead levels from WanaBana products than any other U.S. state between 10/17/23 and 12/14/23 (source is linked below).

FDA is warning consumers not to purchase and to immediately stop using 26 over-the-counter eye drop products due to the potential risk of eye infections that could result in partial vision loss or blindness.
