Drivers should still be concerned about traffic tickets issued to them in other states. Under the Driver’s License Compact, a traffic ticket written in one state can show up on the driving record of someone who lives in another.

The Compact is an agreement among participating states (and most participate) to share driver information. This means that the fines, points, and other penalties can be imposed and enforced regardless of where the person lives.

A holographic will is a will that is handwritten by the will’s creator, also known as the testator. Here the will is not typed and not drafted by an attorney. Different states have different laws governing the validity of holographic wills.

✍️ In New Jersey, the state requires the will to be handwritten, signed by the testator, and signed by two or more witnesses. New Jersey may also admit a holographic will that was not signed by witnesses if the will can be proven to be in the testator’s handwriting.

✍️ New York has much more narrow circumstances under which a holographic will may be considered valid. Holographic wills are viewed skeptically because of their informal nature.

We receive numerous calls from clients every day asking for help about their deceased loved one's estate. Improper storage of the will may cause it to get lost or destroyed. If the will gets destroyed or lost, the courts may have no choice but to presume there is no will and proceed accordingly, resulting in the estate’s distribution being determined by the state’s intestacy laws. One option we recommend is that the will be stored in a fireproof safe immediately after notarization.

Wills can also get misplaced, or purposefully destroyed for personal gain. To avoid these circumstances, the estate plan should not only be properly stored but also be copied and divided amongst the beneficiaries.

The original copy may help prevent a will from being contested. Personal copies are extra security in case something happens to the originals. Distributing the will to the beneficiaries may also help prevent challenges to it since everyone will know what to expect once it is enacted. 📄

A disclaimer trust is used by married couples to create an irrevocable trust for their estate plans. An irrevocable trust is a trust that cannot be altered or ended after its creation, even by the grantor of the trust.

What makes a disclaimer trust unique is that the deceased spouse assigns their entire estate to their surviving spouse with a stipulation. The stipulation is that the spouse is allowed to “disclaim” or “reject” any part of the estate or inheritance.

Any rejected assets get funneled into the irrevocable trust, which is typically controlled by the surviving spouse, meaning that the surviving spouse will still get all of the income and benefits of the disclaimed assets, subject to some conditions.

Often referred to as a “death tax” due to when it kicks in, an estate tax aims to tax a deceased person’s estate before the assets are disseminated to beneficiaries or heirs.

First and foremost, the estate tax at the federal level only kicks in for estates valued higher than $12,060,000. If the gross estate is valued at less than that amount, the estate tax won’t apply.

✅ If your estate value is greater than $12,060,000, there are still ways you can minimize how much tax you have to pay. One way is to set up an irrevocable life insurance trust.
✅ Charitable donations can also help individuals avoid estate taxes. It is possible to create a special type of trust, called a charitable remainder trust (CRT), which will allow the deceased to dictate how their money is sent to charities of their choice after they die.
✅ If the deceased is a business owner who intends to have the business run by their family, they can set up something called a family limited partnership.
