OK, I have had 6-7 of you tell me this weekend that agents want to send the Addendum Regarding Brokers Fees instead of the CABB. This is incorrect in a number of ways.
1. The CABB is payment between brokers, not payment between principals to a transaction. So, if a listing agreement says that a buyer's broker will be paid X%, it is the duty of the listing agent to disclose that amount to the buyer's agent. The vehicle for doing so is the CABB.
2. The Addendum Regarding Brokers Fees is an understanding between prinicipals to a transaction on how the brokers to the transaction are being paid. It also serves notice to title of such. It is also an important vehicle, if the seller is not paying, to make the commission paid to the buyer's agent by the buyer, part of the contract and, therefore, part of the closing costs to the buyer. This is really important.
3. The CABB is a stand-alone document. It is an Agreement, an actual contract.
4. The Addendum Regarding Brokers Fees is not a stand-alone document. You see, a long time ago in a land far, far away there were these people. These people spoke Latin. They had a word called addere, which meant "add to, join, or attach". So, to have an Addendum to a contract, one must have a contract to add to, join, or attach. For example, hmmmm, let me see, a 1-4 Family Residential Contract.
Now, to be fair, if the seller is not offering compensation, a CABB is not needed and you could use seller contributions to negotiate the contract and compensation. Then, once you had done so, AND created a contract to that effect, you would use the Addendum Regarding Brokers Fees to clarify that payment of compensation by adding to, joining, or attaching it to the 1-4 Contract.
I hope that is helpful and clarifies the purpose of each document. If an agent pushes back on that, feel free to have them call me for a Latin lesson. I had to sit through that s**t in middle school. Might as well put it to use.
