Wooton, Davis, Hussell & Johnson, PLLC is seeking an associate attorney with 3-5 years of experience for their Charleston, WV office to handle estate planning and the administration of trusts and estates from inception to completion. All candidates must be licensed in West Virginia. The ideal candidate should be able to:
- Draft wills, trusts, powers of attorney, health care directives, deeds, beneficiary designation forms, and other estate planning documents
- Review and draft trust and probate administration documents and other related documents
- Conduct legal research regarding complex procedural and substantive issues related to probate, estate planning, and fiduciary litigation
- Build relationships with existing and prospective clients through networking and business development activities
- There will be training opportunities for litigation. Candidates should possess a strong work ethic, be detail-oriented, while having demonstrated an interest in litigation.

This role is primarily located in Charleston, WV with occasional travel to our Lewisburg, WV office. Remote flexibility. We offer a salary range based on experience and qualifications as well as Health/Dental/Vision medical and 401(k)

Electronic wills (e-wills) are a hot topic in estate planning circles, but they are fraught with potential for abuse. With e-wills, there is little means of assuring that the person creating the will (the testator) has the appropriate mental capacity. Similarly, there is little, if any, way to ensure that the testator is not being unduly influenced by a particular family member or care provider. Bad News for IRA owners and 401(k) plan participants: The U.S. House of Representatives yesterday passed the SECURE Act. Although it has many beneficial provisions, it does have a significant negative aspect. Specifically, the House leg­is­la­tion would re­quire children or grandchildren who in­herit tax-ad­van­taged re­tire­ment ac­counts to with­draw the money over a much shorter period than many are cur­rently al­lowed. Under the legislation, most non-spouse beneficiaries will have to drain retirement ac­counts within ten years and pay any taxes due in that accelerated timeframe. According to partner John Hussell, if this legislation passes the Senate and is signed into law by the President, the accelerated timeframe for paying taxes will negatively impact millions of Americans who inherit 401(k) plan proceeds and individual retirement accounts (IRA’s) from their deceased parents or grandparents.
