New Michigan Bill Would Let Police Obtain Location Data From Cellphones Without A Warrant In Emergencies – There is a new Michigan bill, HB 4006 that would allow the police to find your location from your cell phone provider without first obtaining a warrant. It is proposed for emergency situations to protect victims of crime, but be careful. When the police can get any information about you without first presenting their reasons to a Judge or Magistrate, our privacy rights are at risk. Of course, there are emergency situations that give credence to go around our long-standing and constitutional rights to be free from illegal searches and seizures, but those are limited and specifically defined. The question is: Should we now legislate another way around our constitutional protections? Police officers have to get search warrants after swearing to the facts supporting the warrant to an impartial Magistrate. It happens every day and yes, it takes more time for the police.

What Happens To My Driver’s License During And After My OWI Case In Michigan If I Have Given A Breath Or Blood Sample? What If I Refused?
If you’re charged with Operating Under the Influence, you don’t immediately lose your license. The officer will give you a temporary driving permit if you cooperated by taking a breath test or urine test. The paper permit allows you to drive unrestricted (as long as your driver’s license was unrestricted prior to getting stopped) during the pendency of your case. What Are Some Factors That Would Enhance Or Aggravate An OWI Charge In Michigan?
In Michigan, one major aggravating factor in an OWI case would be the existence of a prior offense. To illustrate, a second offense OWI (OWI 2nd) could earn up to a year (1 year) in the county jail, instead of the 93-day consequence of a first offense, and a third offense becomes a felony with up to five (5) years in prison. Another aggravating factor would be if the OWI had caused an accident, even if no one was injured. If someone was injured or, God forbid, killed, then that could be a felony, which would earn up to five (5) years in prison for a serious injury and up to 15 years for a death. Learn here:

Is An Order Of Protection (PPO) Or A Restraining Order Automatically Put Into Place When Charges Related To Domestic Violence Are Filed In Michigan?
If someone is charged with domestic violence, there is no automatic restraining order or protection order for the complainant, or victim. The defendant is normally arraigned at the court, where bond conditions are set. The court will set what’s called a No Contact Order, which means the defendant cannot have any contact with the complainant. However, the complainant can always go into court and ask for contact or for limited contact (for instance, for the purposes of trying to deal with Friend of the Court issues for a child they have in common, or some other matter). The amount of contact allowed will be subjective with the court. Learn here

Additional Information On The Courtworks Platform In Michigan – Treatment Court is an alternative sentencing program. It employs a dedicated, assembled team, consisting of judges, probation officers, criminal defense attorneys, and third-party therapists and therapeutic programs, as well as other support services providers. They help supervise and support defendants on probation who have struggled with drug and/or alcohol addiction, and who are on probation for a crime associated with or caused by their addiction. In some jurisdictions, Treatment Court also extends to qualifying defendants who are not primarily addicted to drugs/alcohol, but who do have underlying mental health issues. Learn here:

What Are Some Other Features Of The Courtworks Platform?
There are a number of noteworthy features of the CourtWorks platform. The first thing I would say is that it simply gives a lot of flexibility to Courts and third party providers that are trying to help out defendants on supervision and probation. Many defendants come into probation situations because their life is falling apart. There are as many complex stories and reasons for this as there are individual people. For instance, I had a client who was on probation for he**in possession, and had dropped out of high school and had to get a GED. As it turned out, he had dropped out of high school due to an athletic injury for which he was over-prescribed opioids, which spiraled him into a he**in addiction. That part of the equation, joined with his educational and addiction struggles, were pivotal to understanding how to help him get back on the right track. Learn here:

What Exactly Is The Probation Process Like Under Michigan State Law?
First and foremost, there are currently no private probation departments in the State of Michigan. Some states have implemented private probation departments, like private jails and private prisons. These are for-profit companies (whether technically public or private) instituting private solutions to an essentially public need. They are not owned by the government, but rather they are hired by the county or the state to supervise defendants while they’re on either felony or misdemeanor probation. Learn here:

What Is Your Experience In Handling Criminal Defense Cases For Clients In Michigan?
I started my career as a prosecuting attorney in Macomb County, one of the largest counties in Michigan. I was the Chief Criminal Sexual Conduct (CSC) Prosecutor, which meant that I handled all of the criminal s*xual conduct cases involving children and special needs adults, and was in charge of that unit. During my time as a prosecuting attorney, we found that probation was failing, even back then. We noticed that once a defendant was put under supervision or on probationary status after they were convicted, there was a high rate of recidivism and supervision/probation/probation violations. We believed that this was largely due to a complete lack of education by the courts and the defendants, and a complete lack of good communication between the probation officers, the defendants, and the outside agencies and professionals (for instance, counselors) that were trying to correct behavior and set defendants up for success. What Is The Current Law In Michigan As It Relates To Ma*****na Levels In Your System And Operating A Motor Vehicle?
In Michigan, we have what’s called Operating Under the Influence of Drugs (OUID), which involves the same penalties as Operating While Intoxicated (OWI) but has different definitions for what has influenced your driving capabilities. Because ma*****na is now legal in Michigan for both recreational and medical purposes, you’re allowed to operate with the presence of ma*****na. Before ma*****na became legal, they could charge you for having any amount in your system. Now, you can drive with ma*****na in your system, as long as you’re not under the influence, meaning it can’t materially or substantially affect the way that you drive, which is the legal definition of operating under the influence in Michigan. Dangers Of Synthetic Ma*****na And Why It Should Be Banned In Michigan – Whether it is sold as K2, Spice, Black Mamba, Aroma, Mr. Smiley, Eclipse, Dream, Blaze or Red X Dawn, synthetic ma*****na has been on the market since around 2006. These products are touted as teas, herbs or incense and are generally peddled in convenience stores and smoke shops as “aromatic potpourri,” with nothing more than a warning that they are “not for human consumption.” Once it was discovered that standard urine tests would not detect the use of many of these products, their popularity mushroomed. Teens on probation for minor offenses such as MIP or Possession of Ma*****na, are turning to Spice and other synthetic drugs so as not to get violated on probation.
