Trench Docket Report - We Fought The Law And We Won:

🎼🎶 We fought the law, i.e., a local legal system and the powers that be, and we won [for our client]. 🎶 🎼

We took on a case in which our client, a young person eligible for a diversion program, was charged with 5 felony offenses including one that commonly requires mandatory consecutive imprisonment. At first, the prosecutor insisted that he had to go to prison to get the diversionary sentence or if he wanted to avoid prison, he had to forego the diversionary program and plead to felonies. Prosecutor: to get diversion, he must go to prison. Our position: they’re wrong. They confidently, literally and repeatedly told us that we were wrong. We pulled the cases and statutes - we were right. When we presented that position, the prosecutor changed positions - we were right but their local practices barred diversion unless he went to prison.

We resisted. We went to preliminary examination, 1 count dismissed. We presented more information about our client and the offense to the judge and prosecutor. Finally, the judge relented. While not a trial victory (we’ve had plenty of those), it was a victory nonetheless. We explained the law to the prosecutor, court, probation department and high up prosecutor. Our position never wavered because we were right.

Just because a prosecutor and judge say that something is so doesn’t mean it is. Some live in their cocoon to such a degree that they’re immune from changes in the law or legal interpretations that disrupt their practice of doing it differently. Our client has a new lease on life — no conviction, no record, no prison.
