2023 - THE EVIDENCE!

Evidence and investigation tactics are key to winning cases. As we close out 2023, here are a few notable pieces of evidence and investigation tools that helped us resolve cases this year:

GOOGLE STREET VIEW: In a parking lot design defect case, the property owners denied their lot was unsafe and that others drove through it too fast. The Google Street View website took a snapshot of the lot from years earlier. The image revealed that the owners put down temporary speed bumps in the parking lot which contradicted their earlier defense. The case settled just before trial started.

THE WRONG GLUE: A wall gave way at a construction site and a worker fell and broke his back. The defendant contractor denied responsibility and argued that they used epoxy correctly to hold anchor bolts in place, which in turn held up the wall. Rather than simply hire a construction expert, we reached out to the actual epoxy manufacturer in Texas. The company vice-president of product safety (who was also a product engineer) provided an affidavit that the epoxy was not approved or recommended under the conditions the defendant used it. The case settled not long after that.

WAY BACK MACHINE: This website takes snapshots of the internet at various points in time. Occasionally a defendant will remove incriminating evidence from a website or a blog after an incident occurs. It’s helpful to have an earlier version of their website to question defendants with. And the look on their face when you show it to them is priceless.

INSURANCE STATEMENTS: Nothing new or exciting here, but a good reminder that recorded statements between a defendant and their insurer can lead to case-making evidence. A recorded statement can lock a defendant in to a liability position that their lawyers may try to contradict had the statement not been produced.

As noted in the article, "[t]he whistleblower, Dr. Vincent Polito, alleges that Shire failed to comply with Drug Enforcement Administration mandates, such as monitoring and reporting suspicious drug orders for a certain period. The whistleblower asserts that his termination from the company resulted from repeatedly blowing the whistle and ultimately informing the company's Chief Compliance Officer against the wishes of his management."

Both drugs are listed as Scheduled II controlled substances because they have a high potential for abuse and can cause severe psychic or physical and or psychological dependence. As noted in the article, the abuse of these drugs during Covid “has quite literally been off the charts.”

Both Mr. Combies and Mr. Hanson look forward to trying this case soon in Middlesex Superior Court on behalf of Dr. Vincent Polito.
