Lawsuit Reform - SC Chamber 04/12/2023

South Carolina's yearly legal costs make up 2.5% of the state’s annual GDP. Businesses are paying for many of these costs through high liability insurance premiums and litigation costs.

South Carolina needs civil liability reform NOW to remain a competitive state to do business in.

More here:

Lawsuit Reform - SC Chamber We are focused on improving South Carolina's legal climate. South Carolina needs to base fault on a fair share of liability, not deepest pockets.

South Carolina’s civil justice system is severely out of balance. The current system is not fair to South Carolinians who are working hard to create jobs and grow our state’s economy. Parties should be held responsible for harms and injuries they cause, but not the harmful actions of others.

Advisory Question 3 on the June 14, 2022 Republican Primary Ballot asked voters to select yes or no to the following question:

In a situation where there is more than one person responsible for damages in a lawsuit, do you support changing South Carolina law so that each person should pay damages based on that person’s actual share of fault?

The response to this question shows a strong desire for reform, as 315,504 Republican primary voters voted “Yes.” This question received 86.95% votes in favor and only 13.05% against. This was the highest percentage total—and the highest actual number of votes—received by any candidate or item on the Republican primary ballot.

South Carolina Senate introduces tort reform legislation; focuses on percentage of fault 03/01/2023

“The current system in South Carolina penalizes businesses, especially small businesses, at the expense of a handful of trial attorneys,” said Elizabeth Trenbeath, President of Snelling Staffing Services of the Midlands and current NFIB Leadership Committee chair. “My business is always one lawsuit away from going out of business. This bill is an important step in the right direction to making sure we will be able to keep our employees on the payroll in the event of a lawsuit.”
