The Gutierrez Firm’s Jorge P. Gutierrez Jr. has settled a motor vehicle accident case against a shipping & transportation company for $3,750,000. Per the terms of the confidential settlement, the names of the parties are confidential.

The victim, a 32-year-old mother of three, was rear ended by a commercial vehicle that was exceeding the speed limit of 45 mph and had over 8 seconds to see the victim directly in front in the same lane. Gutierrez was able to use the Defendant’s on-board video to establish the vehicle was actually speeding up as he approached the victim. The victim however had some comparative fault as she was significantly slowing her vehicle down in an attempt to take an off ramp before impact.

Victim went to the hospital on her own later that evening complaining of mild TBI symptoms and a concussion as well as shoulder, neck and back pain. She underwent a series of pain management injections, and physical therapy before undergoing shoulder surgery and a one level Cervical Fusion. Past medical bills totaled approximately $450,000.
