After publishing her note “Emojis: An Approach to Interpretation” in the UC Law San Francisco Communications and Entertainment Journal, MSLR Managing Editor Patricia Graham continues her exploration of these colorful hieroglyphs on the MSLR Online Forum. In her new essay, Graham compares how other countries have grappled with emojis in court cases, and emphasizes the challenges that can come with varying cultural interpretations.

How are bad leaders removed from power? Usually not through the formal methods for removal, notices MSU College of Law Professor Mae Kuykendall. In the MSLR Online Forum’s latest Article, Professor Kuykendall analyzes the tendency to remove Presidents and other leaders through improvisational methods rather than constitutionally provided safeguards. Why do American officials evade utilizing formal rules? Is there a downside to not creating a formal record of admonishment?

Hot off the presses! Michigan State Law Review just published its most recent Symposium Issue: The Evolving Realm of Soft IP: Copyrights, Trademarks, Trade Secrets, and Publicity Rights. For this Symposium, MSLR invited several soft-IP scholars to explore the current legal landscape of copyrights, trademarks, trade secrets, and publicity rights. We are incredibly excited to share with you some cutting edge scholarship on these hot topics!

This past year, two MSU Law Professors have contributed their thoughts on the Major Questions Doctrine to the MSLR Online Forum. First, MSU Law professor James Ming Chen’s “Scalia’s Major Mousetrap: The Modest Origins of the Major Questions Doctrine” tracks the origins of the doctrine and argues it “threatens to eclipse textualist statutory interpretation.” As always, Professor Chen’s piece masterfully and engagingly criticizes the doctrine’s weaknesses.

In response, MSU Law Professor Staszewski builds on and challenges Professor Chen in “Major Questions and the Ecosystems of Regulatory Jurisprudence.” Prof. Staszewski argues that only liberal textualism is under attack by the doctrine, as it forces agencies to choose more conservative textualist interpretations of statutes. Prof. Staszewski agrees with most of Chen’s critiques, but parses out what he calls the “ecosystems” of regulatory agency jurisprudence.

Thank you to both Professor Chen and Staszewski for contributing such great pieces of scholarship to our Online Forum on such a rich and timely topic. Keep up to date on some of the most recent scholarship on the Major Questions Doctrine on the MSLR Online Forum!

Meet Mackenzie Almassian ('24), MSLR Notes Editor.

Last summer Mackenzie worked as a law clerk at Elizabeth Abdnour Law, where she worked on Title IX Litigation and Employment/Labor Law.

This summer Mackenzie will be joining Foster Swift as a Summer Associate in the Municipal Law Group.

After graduation Mackenzie is interested in pursuing a career in either municipal law, employment law, or general litigation.

Congratulations to MSU College of Law's Arbitration team! Joeseph McCarthy, Executive Editor, and Hannah Cone, Senior Articles Editor, helped to advance their team to the championship round at the ABA National Arbitration Competition last weekend.

Congratulations to MSU Law student competitors, Addison Standlee (3L), Michael Kostuch (3L), Hannah Cone (3L), and Joseph McCarthy (3L) who advanced to the championship round at the ABA National Arbitration Competition last weekend. The team carried all six ballots from the two preliminary rounds and swept the semi-finals with five ballots.

Brent manages Michigan State College of Law’s digital repository and has helped transition the Law College’s journals to a digital publishing format over the last decade. Meet Josh Eggert ('24), MSLR Staff Editor.

MSLR wants to congratulate Josh on securing a 2023 summer associate position with Warner Norcross at the firm's Midland office!

Last summer, Josh interned at the First National Bank of America. While there, he mostly handled litigation that the bank was involved in, but he also conducted research on compliance issues.

In addition to being an MSLR member, Josh has an impressive background as a military veteran. He served in the Marine Corps for seven years and deployed four times, including once to Afghanistan. In 2010, Josh was deployed to Haiti after the earthquake there and provided humanitarian relief. His other deployments were aboard Navy ships where he traveled to roughly a dozen different countries. Some of his favorites were France, Spain, and Italy.

After the Marine Corps and prior to law school, Josh worked for four years in manufacturing supply chain for a global food ingredient manufacturer (a niche industry that he found very interesting!). Additionally, Josh has his BBA in supply chain management from Saginaw Valley State and his MBA from Northwood University.

Josh is still deciding the type of law he would like to practice after graduation, but his primary interests are estate planning and business law.

Meet Cassie O'Hagan ('24), MSLR Staff Editor.

MSLR wants to congratulate Cassie on securing a 2023 summer associate position with Hongiman's Grand Rapids office!

This past summer Cassie worked as an in-house legal intern at First National Bank of America in East Lansing. In this role, she drafted memoranda on a variety of topics including debt collection practices, creditor’s rights, preemption under the National Bank Act, and compliance-related issues. She also assisted in the implementation of a new compliance program that created department-specific risk assessments and conducted staff interviews.

After graduating in 2024, Cassie intends to be a transactional attorney and practice corporate law.

Meet Hannah Cone ('23), MSLR Senior Articles Editor.

MSLR wants to congratulate Hannah on accepting a full time offer as an Associate at Varnum LLP's Grand Rapids office!

Over the summer, Hannah worked in Grand Rapids as a Varnum summer associate. She worked on projects for the corporate, litigation, immigration, labor and employment, and estate planning teams. After graduation, Hannah hopes to either litigate or practice corporate law at Varnum.

Before attending MSU College of Law, Hannah received her MBA from the University of Wisconsin. In addition to being a Senior Executive Board member on MSLR, Hannah is also a member of the Board of Advocates. She competed in the Kaufman Securities Moot Court Competition last year, and she will be competing in the ABA Arbitration Competition this fall. Hannah is also a member of the Business and Securities Law Institute.

Meet Charles R. Sarchet ('24), MSLR Staff Editor.

MSLR wants to congratulate Charles on securing a 2023 summer associate position with Foster Swift's Grand Rapids office in their Business and Tax group!

Last summer, Charles worked at Willis Law in Kalamazoo, Michigan. Charles engaged in extensive hands-on work in a variety of legal areas at Willis such as business and corporate law, real estate, trusts and estates, and general litigation.

Charles is a first generation law student. He attended MSU Law one year early due to his "3+3 Program" through Grand Valley State University. As of last May, Charles graduated Cum Laude with a major in Business Management, Management Information Systems.

In addition to being a Staff Editor on MSLR, Charles is the Treasurer of the Sports and Entertainment Law Society, and he is a member of the Business and Securities Law Institute. After graduating in 2024, Charles intends to pursue a career in either business/corporate law or sports law.

Meet Anthony Hunt (‘24), MSLR Staff Editor.

First, we would like to congratulate Anthony on securing a summer associate position at Dykema’s Lansing office for the summer of 2023!

For his 2022 summer experience, Anthony interned at the City Attorney's Office in Lansing. While interning, Anthony rewrote several city ordinances based on his preemption research, assisted with litigation against a ma*****na grow facility, and engaged in research on the constitutionality of municipal utility projects.

After graduating in the 2024, Anthony intends on pursuing a career in government relations and lobbying law with a focus in cannabis law.

Meet Taylor Mills (‘23), MSLR Associate Editor!

For her 2022 summer experience, Taylor worked for the Little Traverse Bay Bands of Odawa Indians General Counsel and clerked for the tribal court. She developed arguments for federal-state-tribal fishing rights negotiations, drafted judicial opinions on child welfare cases, and created a tribal law handbook as a pedagogical resource for Michigan law schools to introduce 1Ls to the basics of Indian Law. Taylor will present this handbook to the Federal State Tribal Judicial Forum's collective of judges from all three sovereigns.

Although Taylor will receive her JD in 2023, she is simultaneously pursuing her PhD in Philosophy and will defend her dissertation in 2024.

Taylor is interested in litigation and passionate about Indian Law, Immigration Law, and Civil Rights. During her 1L summer, she clerked for Justice Clement at the Michigan Supreme Court. After two summers working with governments, she suspects she will end up being a government attorney!

This summer, Sarah externed for Judge McKeague of the U.S. Court of Appeals for the Sixth Circuit and interned for Judge McCarthy of the Wayne County Circuit Court.
