An Open Letter to the Attorney General and Minister of Justice, Prince Lateef Fagbemi (SAN), Regarding His Unwillingness to Free Nnamdi Kanu.

Dear Attorney General and Minister of Justice Lateef Olasunkami Fagbemi (SAN),

Recently, during the Sectoral Ministerial briefing in Abuja, you responded to questions about Nnamdi Kanu’s case, contrasting it with Sowore’s case, and stated that Kanu’s case should be left to the court. You remarked, “Kanu and Sowore, they are not the same. Up till now if I see Sowore I don’t know him, if I see Nnamdi Kanu, I don’t know him. I called for the files of the two people; they are not the same. While I felt this one should go, it did not give me any difficulty, but I have a difficulty in respect of the other one, and he is being held under the rules and laws of the nation, and I know that it is now in Court, let’s wait for the decision of the Court.”

I have two issues with your statement.

First, your assertion that Kanu’s case is in court and that we should wait for the decision is deceptive. The principle of nolle prosequi under Section 174(c) of the Nigerian Constitution, which you used to free Sowore and are being asked to use for Nnamdi Kanu, applies only to cases already in court. It is fallacious to assert that you cannot interfere in Kanu’s case because it is already in court.

Section 174(c) of the 1999 Constitution states: “The Attorney General of the Federation shall have power to discontinue at any stage before judgment is delivered any such criminal proceedings instituted or undertaken by him or any other authority or person.” This provision clearly applies only to cases that are already in court. Therefore, it is misleading to suggest that you will not touch Kanu’s case because it is in court. Was Sowore’s case not already in court when you intervened and freed him? Your statement undermines the intelligence of the Nigerian people and suggests either disingenuousness or unfamiliarity with your powers under Section 174(c).

Second, you said that Sowore and Kanu’s cases are not the same. The two cases are not the same in terms of what? Your power under Section 174(c) is highly discretionary and should be exercised considering fairness and legal politics. Nolle prosequi matters are not necessarily about the facts; they are about accountability and the ability to detect and correct mistakes in case processes. It is about legal emotional intelligence and the weighing of options in the country’s best interests.

Significant mitigating factors in Kanu’s case make discontinuing it fair and in the interests of justice. His charges have been amended multiple times, and a High Court has ruled that the Nigerian military attempted to kill him. His trial is based on an illegal rendition from Kenya, which both international and Nigerian laws deem unlawful.

The Federal Court of Appeal concluded that Kanu was illegally renditioned and that no court in Nigeria has jurisdiction to try him on charges related to this rendition. The UN Working Group on Arbitrary Detention also concluded that Kanu is being arbitrarily detained and must be set free.

Two civil proceedings have awarded Kanu substantial damages, and the Nigerian Supreme Court confirmed his illegal rendition. These legal precedents weaken the government’s case and depict Kanu as persecuted for his ethnicity, making the application of nolle prosequi appropriate.

Furthermore, the prosecution of Nnamdi Kanu is said to cost the government millions of Naira per court appearance. This is not sustainable or justifiable, especially during economic austerity. Are there better alternatives to address this matter?

Moreover, continuing Kanu’s prosecution is not in the interest of ethnic harmony in Nigeria. Notable politicians like Chief Atiku Abubakar have advocated for political solutions. Prosecution could cause more harm and is not in the public good.

In conclusion, the discretionary power under Section 174(c) is vital for ensuring justice, fairness, and the larger public interest. The case of Nnamdi Kanu exemplifies a situation where your application of nolle prosequi is not just appropriate but necessary. The numerous legal victories for Kanu, the illegality of his rendition, and the significant mitigating factors highlight the unfairness and impracticality of continuing his prosecution.

Your past application of this discretion in other cases should guide your decision-making process in this case. The ongoing prosecution of Kanu perpetuates a perceived ethnic bias, drains public resources, and exacerbates ethnic tensions.

It is imperative to recognise that continuing Kanu’s prosecution is neither just nor beneficial for the country. Discontinuing the charges against Kanu would uphold the principles of fairness and justice, reinforce the rule of law, and promote national unity. This action would align with legal precedents and the broader interest of fostering ethnic harmony and ensuring the ethical administration of justice in Nigeria.
