RP • On November 9th, the Supreme Court heard oral arguments about the Indian Child Welfare Act (ICWA). If this 45-year-old law were to be dismantled, it would have devastating consequences on Native families and Tribal sovereignty. Native children belong in Native families, however those families may manifest, and their livelihoods should never lie in the hands of a SCOTUS whose majority has proven to be one that seeks to entrench the very colonial practices that perpetuated the destruction of Native cultural, tribal, historical, linguistic and ancestral connections. Furthermore, the predominantly White people who continue to either fetishize Native children or seek to corrupt them in a Judeo-Christian manner must ask themselves why, in this day and age, they feel entitled to the bodies and souls of Native children. If you and your white led organization are still reciting land acknowledgments, please know that it is largely performative. The true work is in ensuring that you return stolen land, artifacts and all that was taken from Native people, and pay restitution where required; and in the case of the Indian Child Welfare Act, work to convince white people to leave Native children in their tribes.
