KW Lawsuite Update + Meetings 3/26 & 3/27
Yet AGAIN, the federal court in the K.W. v. Armstrong lawsuit has ruled that Idaho Medicaid cannot keep secrets from people who use Medicaid. Idaho Medicaid wanted to ban adults with developmental disabilities and their advocates from using the SIS-A manual. The SIS-A is the “Supports Intensity Scale – Adult” assessment tool that Medicaid wanted to use to pick people’s budgets.
Last August, the court ruled that keeping the manual a secret would be unconstitutional. The court said that Medicaid’s plan to make budget decisions with the SIS while hiding the SIS manual “defies logic and is antithetical to principles of due process.” You can read that court decision here.
Idaho Medicaid did not like that decision and tried to get the court to overturn it. But this week, the court ruled that its decision will stand. You can read that new decision here.
We do not know for sure what will happen next. The court rulings may mean that Idaho Medicaid will not use the SIS-A at all. Over the past month, the K.W. lawyers have been meeting with Idaho Medicaid to discuss what will happen. That means that now is a critical time for your feedback.
The K.W. lawyers will hold three online meetings to give detailed updates and get your feedback. These meetings are just for people who get Medicaid DD services in Idaho, and their primary advocate. The meetings will not be recorded. All three meetings will cover the same update – you only need to attend one of them:

Armstrong ha dictaminado que Medicaid de Idaho no puede mantener secretos de las personas que usan Medicaid. Idaho Medicaid quería prohibir que los adultos con discapacidades del desarrollo y sus defensores usaran el manual SIS-A. For the second year in a row, LINC is bringing together folks with disabilities from across Idaho to talk with their legislators about issues important to them. From the direct care worker shortage to a lack of accessible transportation, Idahoans with disabilities have a lot to talk about. This event brings opportunity for all to come to the table and share with those that are making statewide policies into law.
Operation Advocacy: Our Care Can’t Wait 2024
Wednesday, January 31 - Day of Training
Thursday, February 1 - Day of Action
During day one of Operation Advocacy, we will present a training around interactive storytelling and how it can be used to create awareness of an issue. There will also be presentations about Fred Riggers Disability Awareness Day, the importance of voting, and the Our Care Can’t Wait campaign. Day one will wrap-up with tours of the State Capitol building.
On day two, everyone will meet up at the Idaho State Capitol building. We will be on hand for the activities surrounding Fred Riggers Disability Awareness Day. It’s a chance for us to show that there aren’t just one or two of us; we’re here in every community across Idaho.
Operation Advocacy is designed for the beginner in mind, but we welcome experienced folks as well. This event has been designed to be a two-day event so people feel prepared to participate in our law-making process. If you have concerns about getting to Boise or need help finding a place to stay while you’re here, our Independent Living Specialists can work with you on a plan to make that happen.
