So my NOT GUILTY streak is alive and well, after the jury deliberated today for less than 9 MINUTES. For those of you who were wondering where I’ve been the last few days, now you know. This was no slam-dunk-walk-in-the-park case, as it was a retrial after a mistrial over the summer (hung jury and improper comment by the prosecutor). This time around the State was more than ready, but so were we.

So the reason Prince and I are both willing to publicly put this matter on blast is because my client got publicly roasted in the press when he was arrested a couple years ago. After a rush to judgment with no real investigation, City of Miami Police overcharged my client with a non-bondable felony…in comes me and we get the charge reduced and two trials later he is free and clear. Unfortunately, the same local and national media outlets who were quick to put his mugshot and bond hearing video as their lead story…they are so far nowhere to be found. This is why everyone remembers the arrest but nobody remembers the exoneration.

Kudos to the jury to for doing right by my client and the citizens of the State of Florida.

A couple of summers ago I posted about surrendering my young client after Miami-Dade Police rushed to judgment on his arrest. After refusing to interview my guy or the witnesses I provided, cops simply ignored self-defense and stand your ground law just to close a case. I took this one on a significantly reduced fee because I believe in my client, but jury trials are always risky. I don’t think I’ve ever posted like this before a trial because it’s always easier to sugarcoat things and only talk about the wins after they happen, but I guess therapeutically I wanted folks to know how trying this job is (no pun intended). Being a criminal trial attorney takes a lot out of you, with clients and their families looking to you for answers and also to be their savior. No, not all my clients are “innocent,” but this one is and holding the government to their burden is about as patriotic as it gets. This trial will be tough, as the shooting is on video and the context surrounding it is less tangible, but I still believe in the system and my abilities, so here we go…

So, I had quite the Lincoln Lawyer day…got driven in a fancy Uber for my client’s trial in which he was facing life in prison. Walked out 2 hours later and secured a conditional dismissal and candidly I’m still a little disappointed he had to accept even that. Trial is a big risk and although the case fell short of a straight-up dismissal or not guilty verdict, my guy is off house arrest and the case is now in the rear-view. One of the advantages I have is that the prosecutors know I will actually go to trial and have a track record of securing many an acquittal, both in the state and federal courthouses, hence the result today.
