If you are a Landlord or a Tenant, you should be aware of the recent changes to the law and court procedures in New Jersey. The moratorium on evictions has been lifted. The new law recognizes the hardships on landlords, especially those landlords with a limited number of rental income properties. As of Sept. 1, 2021, landlords are able to begin filing eviction proceedings, however expect delays. Most Landlord Tenant Court proceedings will now be held remotely. A technology room at your local courthouse can be used upon request. There are several new requirements for landlords, including the mandatory filing of a Landlord Case Information Statement, due five days prior to the court-scheduled Settlement Conference.

The Settlement Conference is also mandatory for both parties to participate. Prior to the Settlement Conference, landlords must certify in their filings that they have complied with the CARES ACT. (https://www.njcourts.gov/notices/2020/n200724a.pdf?c=DfF).

For those landlords who have actions pending before the courts that were “stayed” as a result of the Governor's eviction moratorium (now lifted), the courts are now considering a renters’ applications to COVID-related assistance programs before ruling on an Eviction complaint. Demand For Second Homes Continues Drop

Demand for second homes dropped 19.3 percent year-over-year in August, the third straight month of declines, according to a Redfin report. Demand for primary homes fell 1 percent year-over-year, the second month of declines.
Redfin noted that while demand for second homes fell much more year-over-year than primary homes, there was a surge in demand for second homes during the pandemic, soaring by as much as 172 percent in April.

While interest in second homes is lower than it was a year ago, it remains above pre-pandemic levels. That interest will likely stay elevated, according to Redfin Lead Economist Taylor Marr, due to the permanent shift to remote work for many. Sales of vacation homes made up 6.7 percent of all existing-home sales in the first four months of this year, up from 5 percent in 2019, according to the National Association of Realtors.

“The pandemic isn’t over, but the desire to escape isn’t as intense as it was before. People are increasingly returning to life as normal, with kids going back to school and cities coming to life again,” Marr said in a release. “The housing market as a whole is still booming, just not as strongly as it was in the second half of 2020. Homebuyer competition, migration and home-sales growth have all slowed.”

What Are Common Elements in a Condominium Association?

So, you are thinking of buying a condominium unit. When you purchase a condo unit, in addition to owning the unit itself, you will also receive a percentage ownership interest in the common elements.

Some parts of the living space are considered part of the unit itself and other amenities and facilities are owned and under the control of the condominium association. This varies from one condominium to another.

Generally speaking, interior walls are considered part of the unit. However, the Master Deed should define to what extent the interior wall is part of the unit. Perhaps, the entire wall is part of the unit. However, it is possible the unit owner only owns up to the halfway point of the wall (which may be shared with the adjoining neighbor). The unit owner may only own up to the drywall or only the painted surface area. This is also true with exterior walls, roofs, ceilings and floors. Sometimes the units include ownership of doors, windows, any decks or patios, HVAC systems, etc. . Sometimes the condo association retains ownership of those items. The Master Deed will clarify to what extent the unit owner owns these elements or portions of them. You are able to obtain a copy of the Master Deed and its amendments (if any) for your review.

Common elements are classified as being in one of three categories. They are either general common elements, limited common elements or exclusive common elements.

General common elements are just that; parts of the property that can be used by all unit owners. A few examples would be parks located on the property, stairways and hallways used for general access, laundry room facilities, etc..

Limited common elements are amenities shared by a group of unit owners. For example there may be an outdoor sitting area that is designated to be used by a certain number of units to the exclusion of other units. Maybe every eight units share a specific outdoor sitting area. Each group of eight units has its own specific sitting area.

An exclusive common element would be something to be used solely by a unit owner. For example, the balconies attached to each unit may be considered common elements for maintenance and ownership purposes. However, the specific unit owner would have exclusive use of that balcony. Another unit owner would not be able to use it.

It is very important to know upfront what you will be owning and what you will only have a right to use. As a unit owner with a balcony, you may be responsible to maintain its general condition and upkeep. However, the association may have the responsibility to repair any structural or cosmetic damage to it. These obligations will be spelled out in the Master Deed. You will also want to know what your individual homeowner’s insurance policy is going to cover and what will be excluded. This may have an impact on your decision to purchase, should you feel you don’t want to have certain maintenance obligations or financial responsibility for repairs.

It is highly recommended that you know what it is you will receive and what you will not be getting upon the purchase of a unit in a particular condominium.

What Is A Use & Occupancy Agreement?

A use and occupancy agreement ( U & O) is an agreement made between a buyer and a seller in a real estate transaction. Typically, it is the buyer who “needs” to move into the house prior to the closing of title. It may occur if the buyer must vacate his/her existing home, when they have already closed title on that sale and their purchaser is moving into the house. The buyer may have no where to go and will want to move in even though the closing has not yet occurred for the house being purchased (ex. the new mortgage loan has been delayed and is holding up the closing). There may also be a situation when the seller needs to remain in the house, because their purchase of a new property has been delayed. The u & o agreement must be drafted very precisely to protect both parties interests during this interim period. The agreement must contain a specific time period which it covers, to avoid any ambiguity as to the intent for its duration. Typically, it would only be effective for a short period of time, assuming title will close imminently. The agreement only allows the beneficiary party the right to use and occupy the premises. It does not provide any other types of rights which are typically contained in a lease agreement. In the case of a seller remaining on the property, he/she would pay the buyer an agreed upon amount which typically represents the sum of the daily costs incurred by the buyer for agreeing to close title early, but not moving into the house yet. If the buyer needs to move in early, he/she would pay the seller the sum of the daily expenses which seller continues to incur because the title has not yet closed (ex. mortgage costs, utility costs, real estate taxes, etc.). The agreement should specify the penalty incurred should the party staying in the house fail to vacate it by the time period specified in the agreement. It is good practice for the parties to do a walk through of the property prior to the commencement of the u & o and notate any specific conditions of the property which can clearly be attributed to the seller. It is also good practice for the parties to do a walk through at the end of the u & o term to see if anything significant has altered the property since the first walk through. Also, if it is the buyer who will be moving in early, the seller should continue to maintain their homeowner’s insurance policy for protection in case something adverse happens to the property during this interim period.

Of course, the parties should avoid having to enter into such an arrangement, if at all possible. A u & o scenario can add more complications to a transaction and create unnecessary risks for the parties. Unfortunately, there are situations which warrant a u & o to be implemented.

The housing inventory has still not improved and a seller's market shall remain in place for the foreseeable future. The median price of a home in Morristown, for example , went from , $499,467 ( in May 2020) to $526,369 ( in May 2021), an increase of 5%.

New Jersey Divorce and the Treatment of the Marital Home

So, you are thinking about getting divorced from your spouse. However, you share a marital home and you are concerned about how the home will be addressed upon divorce. There will be several options to consider as to the disposition of the home, depending upon the particular circumstances. The following is a brief discussion about how a marital home may be treated as a result of a New Jersey divorce. New Jersey is an “equitable distribution” state. This means the court will split “marital property” fairly but not necessarily equally. By definition, marital property includes all property acquired by either spouse during the marital period. An exception includes property acquired by inheritance or gift by only one of the spouses. The marital home can be handled in three different ways; 1) sale seeking of the house, 2) a buyout of the house by one of the spouses, or 3) continuation of joint ownership of the house. The sale of the house may make the most sense if both parties just want to move on and put the marital home behind them. Perhaps there is no compelling reason for either to remain in the home (ex. no children still in the local school district). In this scenario, they would just split whatever net profit comes out of the sale. If one spouse prefers to remain in the home, then the remaining spouse would need to buy out the other spouse’s ownership interest in the property. The remaining spouse may need to refinance the home in order to buy out the other spouse’s interest. There may be compelling reasons to stay in the home, especially if there are young children and it would be undesirable to uproot the family. The third option, continuation of joint ownership, would probably be the least favorable choice. This may be an option when the spouses prefer to defer the sale for a certain period of time. Perhaps, they will sell the home when their children graduate from high school or even college. In this scenario, the spouses will need to get along fairly well. Probably, it wouldn’t work well if they could not agree on major decisions related to the maintenance and care of the home. Hopefully, both spouses will be able to come to a mutual agreement on how the marital home should be treated. The divorce process will move along much more efficiently, if both spouses are on the same page.

What Are The Legal Causes for Divorce From Marriage in the State of New Jersey?

The causes for divorce from marriage in New Jersey are controlled by statutory law (specifically NJSA 2A: 34-2 ) There are a total of nine causes ( 8 are considered “fault” causes and 1 is considered “ no-fault” cause). The causes are as follows.

1. Adultery

2. Willful and continued desertion for the term of 12 or more months, which may be established by satisfactory proof that the parties have ceased to cohabit as man and wife;

3. Extreme cruelty, which is defined as including any physical or mental cruelty which endangers the safety or health of the plaintiff or makes it improper or unreasonable to expect the plaintiff to continue to cohabit with the defendant; provided that no complaint for divorce shall be filed until after 3 months from the date of the last act of cruelty complained of in the complaint, but this provision shall not be held to apply to any counterclaim;

4. Separation, provided that the husband and wife have lived separate and apart in different habitations for a period of at least 18 or more consecutive months and there is no reasonable prospect of reconciliation; provided, further that after the 18-month period there shall be a presumption that there is no reasonable prospect of reconciliation;

5. Voluntarily induced addiction or habituation to any narcotic drug as defined in the New Jersey Controlled Dangerous Substances Act, P.L.1970, c.226 or habitual drunkenness for a period of 12 or more consecutive months subsequent to marriage and next preceding the filing of the complaint;

6. Institutionalization for mental illness for a period of 24 or more consecutive months subsequent to marriage and next preceding the filing of the complaint;

7 .Imprisonment of the defendant for 18 or more consecutive months after marriage, provided that where the action is not commenced until after the defendant's release, the parties have not resumed cohabitation following such imprisonment;

8. Deviant sexual conduct voluntarily performed by the defendant without the consent of the plaintiff;

9. Irreconcilable differences (NO FAULT) which have caused the breakdown of the marriage for a period of six months and which make it appear that the marriage should be dissolved and that there is no reasonable prospect of reconciliation.
