Greenberg Law Partner Robert Menna reached a settlement of $1,450,000.00 prior to trial for a motor vehicle collision in the case of Franco v. The City of New York. The 33-year-old Plaintiff was driving through an intersection in Brooklyn when he was struck by a FDNY ambulance. Mr. Franco claimed that the ambulance had a red light and was not utilizing its lights and sirens. Mr. Franco suffered injuries to his neck, back, shoulders, and knees which necessitated multiple surgeries including a two-level lumbar fusion.

Toll or Suspension of the Statute of Limitations?
On March 20, 2020, Gov. Cuomo issued Executive Order 202.8, which declared a state of emergency and "tolled" certain Statute of Limitation deadlines until April 19, 2020. Executive Order 202.8 was extended through subsequent Executive Orders, the latest of which is 202.67 and extended the "toll" through Nov. 3, 2020.
Many have interpreted these Executive Orders as instituting a suspension of the SOL rather than a toll. We may have just received some guidance.
In Foy v State of New York, the Court of Claims ruled that the Executive Orders provide for a toll extending the time limits for the commencement, filing or service of a legal action, not a suspension.

Chief Judge Janet DiFiore announced that NY State Courts are planning to resume some in-person operations, including a limited number of jury trials, with jury summonses being mailed on March 22nd in selective counties. The Courts will continue to conduct virtual appearances in order to limit the number of people in the courthouses.
