As infrequent the opportunities may now be, and gradually getting less with time, canyoneering and mountaineering are my calling. In a different life, as opposed to mostly during my sleep in the still of night, I leave my suit and degree behind, don a harness, and lock my carabiner into place before stepping into the great unknown.

With those day dreams always floating around me, when MSNBC’s Ana Cabrera asked me whether it was the right call for Hunter Biden to refrain from testifying in his own defense, I stole and tweaked a quote from famed climber Barry Blanchard in “The Alpinist”, the story of solo alpinist Marc-André Leclerc. I responded to Ana that testifying at trial in your own defense is “… only for the [very] best clients on their very best days”. Though Blanchard had no intention nor ever contemplated that his statement would be stolen by an attorney and used not for a climber but a defendant in a federal indictment, the quote is nonetheless spot on.

At bottom, with the magnitude of evidence corroborating Hunter’s narcotics abuse, including images, audio recordings, and the testimony of his ex-wife and sister-in-law who was also briefly his partner, and the strong cross-examination of his own daughter, Hunter exposed himself to the obliteration of his credibility, losing potential jury nullification, and harming his opportunity to “hang” a juror who might otherwise have empathy for his drug addiction. Compounding matters, Hunter could have opened himself up to perjury as well as cross examination on his tax offenses that would likely hurt him when his second trial starts later this year.

Very simply, Hunter Biden is not the very best defendant and today would not have been his very best day. His decision not to testify was absolutely the right one.

Ignoring the fact Hunter Biden is being prosecuted by his father’s DOJ and there is no honest assessment that Manhattan DA Alvin Bragg prosecuted Trump at the DOJ’s behest or instruction, it should be lost on no one that the same GOP Congressmen and women accusing the DOJ and FBI of doing President Biden’s bidding, and want to tear those entities and agencies down or even get rid of them, also rallied against the left’s defund the police movement.

Yes, it’s quite rich, and frightening for our nation, that these electeds are so drunk off Trump’s Kool-Aid and so ravenous for his scraps and belly rubs, that they have become what they most hated and protested for so long: anti-law enforcement flag bearers.

I share my response from last night’s 11th Hour with Stephanie Ruhle on MSNBC where we discussed Hunter’s trial as well as Jim Jordan, Matt Gaetz and their fellow GOP Representatives’ unfounded, false, and selfishly dangerous attack on the rule of law and Attorney General Merrick Garland.

During this weekend’s post-mortem on Donald Trump’s “Hush Money” trial in lower Manhattan, MSNBC’s Katie Phang asked me about Todd Blanche telling Fox News’ Jesse Watters that Trump was a smart guy, wanted to be the litigator and argue the case (of course Trump did), made every decision together with Blanche, and was a co-litigant with his attorneys.

Nonsense!

While Blanche may have been deflecting responsibility for the 34 count guilty verdict, the truth is Blanche allowed his client to call the shots when he should have put Trump in his place. No, it’s not easy but when you sign up a client you establish that relationship. That courtroom is my house, not my client’s.

Though it’s a hard lesson, accountability is often a steel-toed kick in the ass when you are unwilling to accept any wrongdoing. When Trump looks in that mirror for the rest of his days, along with that big red Felony Scarlett Letter, he should recognize, though he won’t, that his ego and arrogance got the best of him.

Unfortunately, if you allow your client to dictate strategy and put on a defense witness who implodes, and the prosecution is as methodical as they are thorough, you have quite a hill to climb even if it is always the People’s burden to prove their case beyond a reasonable doubt.

With a conviction on all 34 counts of Falsifying Business Record, Donald Trump becomes the first former President indicted for and convicted of felony crimes. Though 12 jurors found the prosecution proved their case beyond a reasonable doubt, Trump’s now permanent stain is still setting in as he awaits his sentencing on July 11th.

Whether you found the case and the jury’s decision just or not, we should all take off our blue or red goggles for a moment and recognize that our personal feelings aside, there are no winners. Instead, all of us collectively, as a nation, have lost. It is a terribly sad day for America as we wake up this morning with a hangover that we will not soon recover.

Below is a segment from yesterday’s appearance on Meet The Press NOW, NBC’s streaming edition of the program with the same name. Briefly, during one point in the interview (8:25-10:15), I addressed two issues: Robert Costellos’ testimony and what I believed was a missed opportunity for the defense, and whether the judge will submit what is called the “lesser included offense” of the misdemeanor Falsifying Business Records to the jury for their consideration. Whether the prosecution and the defense will want the court to do so is a strategic question that is yet to be seen.

The defense rested. Donald Trump didn’t testify. Of course he didn’t. “I’m shocked”, said no one.

Trump didn’t need to testify and the jury cannot hold it against him for not doing so, but have no misgivings. No matter what lie he perpetrates outside that courtroom - and he has spewed many with reckless abandon and a selfish indifference to the consequences of his words - as I said last night on MSNBC’s 11th Hour with Stephanie Ruhle, the former President simply lacked the chutzpah to open his mouth before the jury and knew he would get eviscerated while tanking his chance at an acquittal or mistrial.

Innocent until proven guilty beyond a reasonable doubt, but it seems Trump undoubtedly listened to his lawyers’ advice and didn’t let his bombasticity get in the way of self preservation.

I am a firm believer in law and order. No matter your politics nor color of the goggles you wear, everyone is entitled to the same presumption of innocence and due process. This includes Donald Trump. If you can’t accept he is innocent until if and when proven guilty because of your politics, then you are no less a part of the problem than anyone else.

With that said, I look forward to joining FOX Business with Neil Cavuto around 12:15 today to discuss Trump’s “Hush Money” trial and, subject to change, CNN’s Erin Burnett at 7 PM this evening. If you’re willing and interested, and you don’t want to view the entire hit, please consider watching from when Donald Trump speaks outside the courtroom around 5:05. Yes, I got, well, a little impassioned and, yes, I said Trump wouldn’t have the chutzpah to take the stand. Sure, I could be wrong and it wouldn’t be the first time, but what I am unequivocally correct about is how Donald Trump’s behavior outside the courtroom is not about free speech.

Objective people can question the merits of the case and examine it in the context of Jack Smith’s indictments, for example, and come to different conclusions. What they cannot do, however, is tolerate the former President’s selfishly dishonest attacks on the court and non-existent corruption, just as we should not tolerate his willingness to tear down our foundation and belief in law and order. For that matter, what is it we all know about what happened today? Finish your thought and tell us, Mr. President. Please, explain!

In lieu of standing silent when Stormy Daniel’s brought up s*x without a condom, only to later ask for a mistrial because the prejudicial testimony was a “dog whistle for rape”, Trump’s attorneys should have opened their mouths to object. While their client may have to live with the consequences of their inaction if there is a conviction, and everyone should remember no matter their political leanings that Trump is absolutely innocent until if and when proven guilty beyond a reasonable doubt, Trump’s counsel should at least open their mouths at their client’s post-court campaign speeches. We, as a nation, are going to have to live with the consequences. Instead of fighting the case in the courtroom, they meekly and mutely stand at his side as their client tries to undermine our nation’s belief in the criminal justice system, attempts to rob law enforcement of credibility, and makes every effort to dismantle law and order as we know it.
