In the case discussed, an appellate court in Pennsylvania ruled that, where a commercial landlord properly evicted its tenant, rather than the tenant abandoning the leased premises, the landlord could only collect unpaid rent and fees up to the date it regained possession.

To celebrate Hispanic Heritage Month, we would like to highlight Mexican architect and engineer Luis Barragán. Barragán graduated from the Escuela Libre de Ingenieros in Guadalajara in 1923 and went on to become a architect in Guadalajara and Mexico City. If you have been to Mexico City, you have likely seen Barragán's colorful, modernist structures, including his famous house and studio, which was built in 1948 and declared a UNESCO World Heritage Site in 2004.

Alan Nochumson recently led his clients to two zoning successes in the suburbs - one in Lansdowne Borough and one in the Township of Upper Darby.

At 29 North Highland Avenue, Alan helped his client obtain zoning approval for a multi-family conversion, and at 223 South 69th Street, he helped his client obtain a zoning permit for the development of a mixed-use structure.

Did you know that September 15th marks the beginning of Hispanic Heritage Month? This month of celebration began as just a week under President Johnson in 1968 and was deservedly made to be a full month in 1988 under President Reagan. Today, and every day, we want to honor our clients and friends!

We represent individuals in eviction cases! Alex Hamilton recently helped a foreign investor client, who owns a property in Point Breeze, evict a tenant who failed to pay rent. After completing the requisite Eviction Diversion Program, Alex helped his client file a lawsuit to evict the tenant. At the hearing date, Alex’s client and the tenant entered into a judgment by agreement, wherein the tenant agreed to vacate in exchange for paying a reduced amount of the back rent he owed. The tenant evacuated the property in less than 30 days and the client is very pleased to now be able to rent the property out to someone else.

This week, as part of Nochumson U, Alan Nochumson presented on the subject of new construction purchases at Philly Home Girls in Fishtown.

Nochumson U is the firm's newest initiative, wherein a member of our legal team will offer a free, educational real estate seminar on a topic of your choosing, at your office (with lunch included - this time, we got catering from Goldie!).

This alert discusses a recent decision by Philadelphia's ZBA, which found that a real estate developer's evidence established an unnecessary hardship because it proved that the property, a vacant lot that needed costly environmental remediation, was practically valueless without the granting of a variance under the Philadelphia Zoning Code. Wish Alan Nochumson luck on his first day of teaching at the Fox School of Business at Temple University! Alan has been teaching the three-credit course "Real Estate Practice" at Temple University since 2021. The course, which is required for the Real Estate Licensing examination, explores Agreements of Sale, the Real Estate Settlement Procedures Act, and the licensing law for real estate brokers and salespersons, amongst other subjects.

We were so pleased to see our clients Ashton Gage, Linard Gay, and Jonathan Harris, receive zoning approval for their 30-unit, 40-parking space, West Mount Airy residential development project. The three developers, who all hail from East Mount Airy, were recently featured in the The Chestnut Hill Local article, "A trio of childhood friends brings development home." The renderings for their 118 East Sharpnack Street project, were designed by Agata Reister of Landmark Architectural Design. We love seeing our clients' residential development dreams come to fruition!

We are in awe of client Dominic Episcopo's historic church, which is a three-story property that has been renovated to feature a two-bedroom owner's suite, an artist studio, and two one-bedroom auxiliary units. The church, which is over 150 years old, was just featured in the Philadelphia Business Journal.

We recently helped our client located on Frankford Avenue save a cumulative $75,000 in real estate taxes over a three-year period. After helping the client obtain a zoning variance for his business, we worked with him to reach a settlement with the Board of Revision of Taxes, reducing the assessed value of his property by over 1.5 million dollars. His property, like many others, was over-assessed after a post-COVID reassessment in 2023, and its value has continued to increase since then. After negotiating with the OPA's assessor, we were able to lock the client in at the drastically reduced assessed value for tax years 2023, 2024, and 2025.
