Job Description

Raleigh-based legal office is seeking to hire a bilingual Spanish/English legal assistant for expanding legal practice focusing on immigration, traffic, and general law. Must be able to operate, work with, adapt and create Microsoft Office and legal case management program. Salary commensurate with experience. Education

Minimum: community college or more and equivalent of two years of paralegal experience

Duties

Administrative Support:

Great clients and visitors
Answer phones and take messages
Perform client intake
Manage attorney’s calendar
Enter, update and maintain date on case management system
Draft and send out legal correspondence
Maintain existing filing system
Create and manage litigation and non-litigation case files that include:
Compile complex government forms, applications and petitions, including:
• Compile court filings for immigration court including applications and evidence of support,
• Conduct research to generate supporting evidence for applications, and
• Index and update litigation files and relief applications.

Management of Law Office:

Client Casework
Work with Venders
Financial responsibilities: send out bills, make bank deposits, and take in client payment.

Skills:

Excellent English writing ability
Ability to speak English and Spanish fluently
Office management experience and advanced organizational skills
Strong administrative and time-management skills
Ability to operate Microsoft Office, Microsoft Word, and learn how to use specialized date and case management software in a timely fashion.

At this stage in my career I relish the small victories. At a master calendar hearing at the Charlotte immigration court this morning I did not concede proper service on my regular grounds, pre-commencement delivery is invalid, and non-statutorily compliant notice is invalid. The immigration judge asked the trial attorney (TA) if she had a response, and TA offered to orally amend Notice to Appear (NTA). When specifically asked about the service argument she said she had no argument. I opposed on the grounds of the BIA decision Matter of Aguilar-Hernandez stating the only thing that can be added or changed are facts and charges by I-261 no other changes allowed. IJ said she fully understood both aspects of my argument and further stated Matter of Fernandes does not require termination and allows changes apparently leaving it in the hands of the IJ as to what is acceptable. So IJ was going to allow changes. In saying this she also says that this has been the way it has always been since "time immemorial" etc etc etc. but my objections were noted. When finished I asked if I could comment to which she said yes. I said with all due respect, you are wrong. Pre-Illegal Immigration Reform and Immigrant Responsibility Act (IIRIRA) in deportation it was the warrant for arrest not the order to show cause that commenced the proceeding and therefore all required statutory notice was served post-commencement. She chimed in yes, but those notices also had t/b/d dates times and places. I said yes they did but the prior statute allowed the statutory notice to be delivered in multiple pieces. And that the Immigration and Nationality Act (INA) stands as 45 years of statutory precedent for post commencement service of notice. And she said, yes well the IIRIRA came and nobody changed their practicess not Legacy Immigration and Naturalization Service (INS), later Department of Homeland Security (DHS), not the Executive Office for Immigration Review (EOIR). I said yes, but that does not make it right. That is a failure of the BIA, and of the EOIR I said. She acknowledged as much and she said it is up to the BIA/EOIR to make a major policy change. I declined to plead and TA said she had the I-213 but would be making a motion to dismiss to which we all agreed. But the IJ said are you sure you want to agree you can take this issue up to the board. I said it would be a good case at the BIA, but I already have numerous cases pending there on this very issue and she smiled at me. That simple smile made the last 5 and a half years since the Supreme Court decision in Pereira v. Sessions worth every minute.

Biden's SOTU speech was excellent. Of course I am biased. But at a bare minimum any questions about his cognitive abilities are put to rest. He knows what is going on plain and simple. An interesting piece I picked up at the end where he said "

I see a future where we defend democracy not diminish it.

I see a future where we restore the right to choose and protect other freedoms not take them away.

I see a future where the middle class finally has a fair shot and the wealthy finally have to pay their fair share in taxes.

I see a future where we save the planet from the climate crisis and our country from gun violence".

Sounded very much like MLK's "I have a dream . . ." Well done Mr. President!
