The weather is a reflection of my current mood. We are in Hong Kong looking across the bay at Shenzhen, China. The physical landscape of both Hong Kong and Shenzhen is changing rapidly. Yet, there are still fishermen using traditional methods to earn a living.

Why can't women be strong, steely and respected? I grew up with a mother who was steely but compassionate, strong but loving, honest in listening to her inner voice but resolute in her values. Why can't women embody strength, steeliness and also be a beautiful woman warrior?
I want to wish a very Happy Mother's Day to all the strong, steely and loving mothers out there! Don't compromise your values because the media wants only "nice" women.
ANTI-SPAM LAW - IRELAND
If your clients or potential clients are located in Ireland, you must have an "opt-in" showing express consent before marketing or promotional emails or text messages can be sent.

ANTI-SPAM LAW - AUSTRALIA
Australia's 2003 The Spam Act applies to emails, instant messages, SMS (text messages) and mobile phone messages.
Under this Act, it is illegal to send unsolicited commercial electronic messages originating in Australia or sent to an address accessed in Australia unless:
1) consent was obtained either express or implied derived from dealings with the recipient;
2) the message must clearly and conspicuously contain an "unsubscribe" option; and
3) accurate details of the individual or organization sending the message must be provided.
ANTI-SPAM LAW - UNITED KINGDOM
The United Kingdom Privacy and Electronic Regulations of 2003 makes it unlawful to transmit a message for direct marketing purposes by telephone, email or SMS without the prior consent of the recipient.
In order to obtain express consent, the opt-in request must contain:
1) the identity of the sender;
2) ask for consent to receive advertisements of products or services from you;
3) inform that you may promote brands, seminars, competitions and third party products; and
4) provide notice that the recipient may unsubscribe at any time.
ANTI-SPAM LAW - EUROPEAN UNION
Anti-Spam laws in Europe all fall under the 2002 European Union directive on Privacy and Electronic Communication.
However, each member state is free to translate and develop their local law.
Generally, prior explicit consent is required before sending an electronic message (email, SMS, voicemail, or fax) and an opt-in (or unsubscribe) option must be provided that is clear and easy to understand.
We will go over the specific requirements of each country.

ANTI-SPAM LAW - CANADA (PART 2)
Under Canada's Anti-Spam Legislation ("CASL"), a Tweet, Facebook or Instagram post is considered public, similar to content shared on a website, providing an update to your status.
The CASL does not apply to social media posts. However, any one-on-one or one-to-few communication including private or direct messages on social media platforms and posting to groups requires CASL compliance.
Under CASL, a "connection", "follow" or "like" on a social media network does not constitute express consent for someone to reach out via email or direct message to solicit or advertise a product or service.
ANTI-SPAM LAW - CANADA (PART 1)
If you are in Canada or have clients located in Canada, you must comply with Canada's Anti-Spam Legislation (CASL) which became effective on July 1, 2014.
This legislation applies to all commercial electronic messages which are email, texts, instant messages on social media platforms such as Facebook, Twitter, Instagram, LinkedIn that advertises or promotes products, services, people, personas, companies or organizations.
Under CASL, consent or "opt-in" is required before sending a commercial electronic message.
In order to obtain "express" consent, you must describe why you are requesting consent, provide the name and contact information (mailing address, telephone number or email address) of the person seeking consent, identify the person whom you are requesting consent, and advise that the recipient may unsubscribe at any time.
ANTI-SPAM LAW - UNITED STATES
In 2003, the U.S. Congress enacted the CAN-SPAM Act. This Act makes it unlawful for any person to send a commercial email message unless:
1. It clearly and conspicuously identifies that it is an advertisement or promotion;
2. Provides notice that you can "opt-out" from further email messages;
3. Accurately identifies the person or business who initiated the message;
4. Lists a valid physical postal address from the sender;
5. The subject line must reflect the content of the message.
This law applies not only to bulk email but covers "all electronic mail messages the primary purpose of which is the advertisement or promotion of a commercial product or service".
It has been interpreted to apply to LinkedIn, Facebook, Twitter, and Instagram instant messaging platforms.
ANTI-SPAM LAW - CALIFORNIA
California's Anti-Spam Law is one of the most stringent in the nation. It prohibits anyone from sending "unsolicited commercial email" from California or to a California email address. If you did not have a prior established business relationship with the email recipient, then the message is an "unsolicited commercial email".
U.S. COPYRIGHT LAW - WORK MADE FOR HIRE
"Work Made for Hire" is connected with the U.S. Copyright Act of 1976. As the author of a work you automatically own the copyright. However, with "work made for hire", the person paying for the work is treated as the author. If you are an employee, the copyright to any work you produce in the course of your employment belongs to your employer. However, you can create a contract to retain the right of ownership.
So grateful that my daughter got to meet the Chief Justice of California, the Honorable Tani Cantil-Sakauye at the Justice and Diversity Center's award ceremony for Outstanding Volunteers for Public Service.
U.S. COPYRIGHT LAW - AUTHORSHIP
An author of a work (poetry, photography, art, graphic design, blog, book, musical works, etc.) is the owner of the copyright. The copyright owner has exclusive rights to reproduce, distribute, display, perform or create derivative works. Copyright protection lasts from creation until 70 years after the author's death.
C CORPORATIONS
The most common type of corporation in the U.S. is the C corporation. The profits of a C corporation are taxed twice: once to the corporation and again to the shareholders under sub chapter C of the Internal Revenue Code. C corporations offer unlimited growth potential through the sale of stocks. There is also no limit to the number of shareholders a C corporation can have.
S CORPORATIONS
A corporation can avoid being taxed twice (once to the corporation and again to the shareholders) by choosing to be treated as an S corporation. Then only the shareholders are taxed. An S corporation is created through an IRS tax election. However, the business must be an eligible corporation and regulations vary by industry, state and locality.
LIMITED LIABILITY COMPANIES
A Limited Liability Company ("LLC") has characteristics of a sole proprietorship and a corporation. Similar to corporations, members of the LLC are not personally liable for the business decisions and actions made on behalf of the entity. For tax purposes, the LLC is not considered a separate business entity. Instead, all profits and losses are "passed through" the business to the individual members. Depending on the state, members of the LLC can be individuals, partners, a corporation, or another LLC.
SOLE PROPRIETORSHIPS
The simplest and most common form of a business is a sole proprietorship. The business is owned by one individual with no distinction between the business and the owner. The owner has exclusive authority to make business decisions but is also responsible for all debts, losses and liabilities.

Photographs and images are the intellectual property of the photographer. Ownership of the pictures and images stay with the photographer. If you purchase an image you are given permission from the photographer to use that photo. Protect yourself and the photographer with a copyright notice.
