In this month’s California Lawyers Association E-Briefs, firm associate David Lerch and Wolf Haldenstein summer associate Nathan Khan have analyzed the United States Court of Appeals for the Second Circuit’s first consideration of an Actavis claim in a published opinion.

In May 2024, the Second Circuit affirmed the district court’s dismissal of the plaintiffs’ claims in In re Bystolic Antitrust Litigation, concluding that the plaintiffs did not plausibly allege that Forest Laboratories’ payments to the generic manufacturers to keep their product off the market were unjustified or unexplained, as required by the Supreme Court in Federal Trade Commission v. Actavis, Inc. The Court concluded that the agreements were legitimate business transactions and there was no evidence of anticompetitive intent.

Jackson Hewitt No-Poach Case Update:

The Joseph Saveri Law Firm is Interim Co-Lead Counsel on behalf of a proposed plaintiff class in an antitrust class action against defendants Jackson Hewitt, Inc. and Tax Services of America, Inc.

From December 2014 to the present, defendants and other co-conspirators allegedly engaged in a conspiracy to not compete for employees and potential employees.

On April 5, 2024, plaintiffs filed a memorandum in support of unopposed motion for preliminary approval of settlement and certification of the settlement Class. The proposed settlement would establish an all-cash Settlement Fund of $10.8 million, which represents 100% of the actual damages plaintiffs’ expert preliminarily calculated as of the time plaintiffs filed their motion for class certification based on then-available data through February 29, 2020.

Firm associate David Lerch dives deep into a recent victory for construction equipment distributors in this month's California Lawyers Association's E-Brief!

On April 15th, 2024, a Delaware District Court decision went in favor of a distributor using an online platform to distribute construction equipment purchased in China in the case of International Construction Products, LLC v. Caterpillar (D. Del.). This case involved Sherman Act claims and a hub-and-spoke conspiracy.
