I left the District Attorney’s office in 2014 to open a criminal defense practice. Just a few months later, I was retained by a young man who was arrested for a special circumstance murder (this means if he were convicted, he would be eligible for the death penalty). I have handled hundreds of cases since then from start to finish. But his case has endured. Hundreds of hearings and multiple trials over many years. He never wavered on his innocence. He has been in custody for almost 7 years, being held without bail.

Today, almost 7 years to the day of his arrest, a jury of his peers declared him Not Guilty. His mom and grandma, who have attended every court appearance over the years, were there to see it.

Our country may have a lot of issues and division, but there is nothing more beautiful than 12 strangers coming together and declaring control over what the government believes to be true. Three days ago, prosecutors asked the jurors to send him away for life. Instead, today, they sent him home.

The BHPD will conduct a DUI and Driver’s License Checkpoint on September 9 in the area of Santa Monica Blvd., and Crescent Dr. between 8:00 pm and approximately 2:00 am. Two years ago I represented a young man charged with a violent carjacking. He was arrested. Luckily his financial situation allowed him to bail out and hire an attorney. At his arraignment, the District Attorney offered him the “low term” in state prison. My client was factually innocent. A brutal crime blinded the prosecutor’s vision of the truth. We presented exculpatory evidence to the assigned DA. He wasn’t moved. We took it up the chain of command to someone who finally listened and eventually dismissed the case. We then filed a petition for factual innocence which was granted by the court.
