In Oklahoma, law enforcement folks are not allowed to give opinions as to whose fault a wreck was. There are policy reasons behind that rule, mostly the Courts believe jurors will give too much weight to a law enforcement officer's opinion.

Going to start posting more frequently here. Today, on pi day, I will be doing some jury research on a case I am working on. It is a medical negligence case. I cannot say too much about it as my opponents may have access to this information. Jury research projects, sometimes called Focus Groups, help lawyers find out what "real people" think about a particular case. Lawyers tend to get "tunnel vision" when working up a case and sometimes do not see the other side of the story. A well run Focus Group will point out the good, the bad and the ugly about a case. A lot of times, jurors do not share the lawyer's belief as to what is the most important issue in a case. It's going to be a real learning experience.

A tragic ruling decades ago that has no application to the real world prevents our service men and women from suing government doctors for maiming and killing them because for some reason, the Congress and Courts give immunity to those doctors and the government. Today the Oklahoma Supreme Court held that the Oklahoma Constitution does not allow special interest groups like the Chamber of Commerce, the Insurance Cartel, Big Pharma or the Medical Mafia to decide how much a jury of the people of the community can award a person for non-economic damages. These special interests purchased the legislature more than a decade ago and rammed through a bogus "cap" of $350,000 for non-economic damages, meaning that if you, your spouse, your child, your parents or anyone else you loved, had to have all 4 of your limbs cut off due to somebody else's fault, you could only recover $350,000.00 for your pain and suffering and loss of enjoyment of life. Under today's ruling, a jury of your peers, not the bought and paid for legislature, will make that decision. Long live the Oklahoma Constitution. Long live government of the people, by the people and for the people.

A woman who lost her toe in an escalator accident has been awarded $3 million
$3 million for a toe. Seems like a lot but I imagine the person who lost the toe does not think that. I don't have all the details but I imagine the mall had plenty of notice that the escalator was a POS and just decided not to do anything about it and hope that nobody got hurt. OOOOPS

Good morning America, how are ya'? Laizure Law has resolved a case against Allstate-Mayhem-Good Hands. In the old days, the case would be over and we would get a check in 10 days and move on down the road. The new paradigm is that we have to deal with Medicare and its various "agents". Who would ever think dealing with Allstate is easier than dealing with Medicare? I told the very nice Allstate adjuster that I would rather go to the dentist and have my tooth pulled with no anesthesia than to listen to this sub-humans try to tell me they are entitled to more than the law allows.
I know others have real problems, and I need some cheese to go with my WHINE and maybe a ride in the WAHMbulance. Anyway, venting over. Back to work.

First Trial Over Roundup W**d Killer Cancer Claim Under Way
This is an incredibly tough case to take to trial. Monsanto has legions of lawyers and endless sums of money to defend itself. Monsanto can hire many scientists to "prove" its product does not cause cancer. The jury is going to have to decide what "science" to believe. If the case is in federal court, and if the Plaintiff wins, good luck keeping that verdict with the Chamber of Commerce/Corporate America protector aka SCOTUS.
