Yorba Linda City Council Strongly Opposes new Housing Mandates. City Opposes SB 423 and Encourages Residents to Take Action

The City of Yorba Linda and the League of California Cities are encouraging residents to oppose a new housing bill that strips local control and takes decisions away from Yorba Linda residents. California SB 423 (Wiener) would greatly expand SB 35 provisions and eliminate its 2026 sunset date. This measure would double-down on the recent trend of the state overriding its own mandated local housing plans by permanently forcing cities to approve certain housing projects without regard to the needs of the community, opportunities for environmental review, or public input. Furthermore, this bill will strip local communities of nearly all important land use decisions. The City of Yorba Linda supports local control and the rights for community input regarding traffic, parking, and other potential development impacts. Local elected officials, as well as members of the community, must have an opportunity to weigh in on such decisions, so that the full extent of the local impacts of proposed projects can be considered.

Yorba Linda Housing Mandate Next Steps Survey
Now that Measure Z has been soundly voted down , there is a next step. Voting NO on Measure Z only allowed a short reprieve but did not remove The Mandate .
Some actions are occurring outside of the city to challenge the Mandate's assigned Dwelling Unit numbers, but it is not clear when or to what degree those activities will bear fruit. Yorba Linda is still tasked with developing a revised housing plan and that work has already begun by the city.
You were crucial in sending the overwhelming message that the proposed plan was Not acceptable. Your opinion is critical to being able to contribute to the development of a Yorba Linda housing plan that is more amenable to the residents and voters in Yorba Linda.

For Consideration Regarding Measure Z
“I attended the meeting this week and they presented the slide that Justin shared about what yes vs no means.

But like everything, I like to do my own research and validate what I’m being told so I can make an informed decision.

From my perspective it’s not a question of voting yes or no, it’s about whether to vote yes or no right now. It’s more about timing and evaluating the risk between the two decisions. So I’m asking myself, Do I vote yes now or in 2024?

A yes now means 19 of the 27 sites are rezoned, a irreversible action decided on by the residents of YL. Gets the city 75% towards their RHNA target right now, 3 years ahead of the target deadline.

A no on Z means the rezoning is deferred to the 2024 ballot or sooner if the city decides to hold a special election. Mind you there will be another ballot anyway because there is a shortfall of 800 units due to the deferral of the 4 properties. So either way there is a 2022 AND 2024 ballot.

What a no vote does not do is decertify the plan. The risk of that happening is very low as stated in the meeting. They mentioned the risk of external parities suing as being higher risk like the builders remedy but I looked that up as well and it hasn’t been proven to hold up in court yet. Also, that only happens if a city doesn’t have an approved plan which YL does. Also for the state to take over local control, that would also have to go through the courts (refer to HCD’s incentives and consequences policy).

So could it happen? Possibly, but not likely.

So why would someone vote no? From my perspective, It would be to take advantage of the additional time provided by the state (SB197) and minimize the risk of the city forfeiting their ability to benefit from anything taking place that could have a significant change in the numbers or the law: 1. The state audit 2. Petitions by cities questioning whether removing local control is even constitutional. 3. Opportunity for the city to take a step back, engage the public (not just property owners) and create a master plan for our city.

So at the end of the day, that is how I’m choosing to balance the decision to vote yes or no on this measure right now. But that’s me so encourage everyone to do their own homework and make their own decision as well.”

The Yorba Linda City Council approved a plan to “defer” rezoning in some areas but to move forward with ReZoning in others. It does not make it any less likely to happen. The only way to assure this ReZoning does not happen is to vote NO on MEASURE Z.
A new law, SB 197, will delay the requirement to ReZone by ~ 3 years.
A better, more equitable plan CAN be developed during this time. What can you do:?

Don!t Throw Away Your Right to Vote !!!!
When YL Measure B was voted in by the Ci7zens of the City in 2006 it had two
main provisions;
1. A vote of the people to change any zoning.
2. Mandated a Maximum building height of 35 feet.
This ReZoning Measure Z raises allowable building heights in many zones in
the city from 35!"to 40! (3 stories), and as high as 50’ (4 stories) in other areas and basically removes both of the original provisions by these changes.

CITY STATEMENT: “A Yes Vote on Measure B means ...
Yorba Linda demonstrates its ability and commitment to meeting future and anticipated housing needs as well as provides greater protection from lawsuits while compliant with State law.”
THE TRUTH: A Yes Vote on Measure B will not protect the city from lawsuits. Yorba Linda has already received State certification on our Housing Element Plan.
YORBA LINDA CITY ATTORNEY TODD LITFIN SAID: “... our certification is premised upon us going forward
