legal empowerment and emancipation for the youth. Providing for basic children's rights .

23/07/2024

Hello good people, it is my honour on behalf of JCC to express how happy we are. As usual, this past Wednesday we had our guest presenter Mr Donald Jose, a man who has passion over human rights, he perfectly executed section 19 of the Constitution of Zimbabwe that focuses on the rights of the child. To delve into the discussion, he pinpoint the importants of section 19 including
1. Protection of Children's Rights: It specifically focuses on the rights and well-being of children, ensuring their protection from abuse, neglect, exploitation, and violence.

2. Prioritization of Best Interests: The section emphasizes the importance of prioritizing the best interests of the child in all decisions affecting them.
3. Protection from Harmful Practices: The section protects children from harmful practices like child marriage, female ge***al mutilation, and forced labor.
4. Promoting Children's Development: By ensuring their physical, emotional, and psychological well-being, Section 19 promotes children's development and future prospects.
5. Empowering Children: The section empowers children by recognizing their rights and freedoms, enabling them to assert their interests and needs.
6. Guiding Legislation and Policy: Section 19 serves as a foundation for legislation and policy development, ensuring that children's rights are considered in decision-making processes.
7. Enhancing Accountability: Section 19 holds stakeholders accountable for promoting and protecting children's rights, ensuring that responsibilities are upheld.

All in all, it was a insightful discussion that also tackled some other preliminary matters such as the disputed age of consent which is now 18 years according to Statutory Instrument 4 of 2024.
In light of unpacking section 19 of the Constitution of Zimbabwe, the recent case of Murambinda police parading suspected juveniles was also discussed. As juveniles are part of children, they need to be treated as a vulnerable group despite them being suspects of a crim of burglary.

Another interesting story concerning children is that of a 1 year old child whose mother was imprisoned together with the child, is this lawful? This is a question open to be answered in line with the case at hand.

The Constitution of Zimbabwe places emphasis on youth involvement and empowerment in several sections, showcasing the country's commitment to integrating youth into its socio-economic and political fabric. Specifically, Section 20 of the Zimbabwean Constitution is dedicated to youth. It underlines the importance of the State and society in ensuring that youths are provided with opportunities to associate, be represented, express themselves, and also emphasizes the creation of opportunities for employment and education. Additionally, it highlights the need for youth participation in political, social, economic, and other spheres of life.

This provision reflects a recognition of the crucial role that young people play in the development of Zimbabwe, aiming to harness their energy, creativity, and aspirations for national development. It’s important to review the most current version of the Constitution of Zimbabwe for any updates or amendments related to this topic.
