The New Marriages Act in Zimbabwe: Key Points

Recognition of Marriages:

Equality: Both customary law and civil law marriages are now recognized as equal, eliminating a previous disparity.
Registration: Registration, while not compulsory, grants legal protection and clarity regarding property rights and inheritance.
Minimum Age and Consent:

Child Marriage Ban: Marriages for persons under 18 are strictly prohibited, addressing a longstanding issue of child marriage.
Free Consent: Both parties must freely and fully consent to the marriage, emphasizing personal autonomy.
Other Notable Changes:

Inheritance Rights: Partners in unregistered customary law marriages, may now have inheritance rights upon the dissolution of a relationship or death of a partner.
Gender Equality: The Act promotes gender equality within marriage, including regarding property division and spousal maintenance.

contribution during the acquisition of immovable property by the parties which is an issue laid to rest in this Supreme Court judgment. Divorcing parties have failed
to understand that the properties they individually acquire during the subsistence of the marriage should be disclosed to the Court during divorce proceedings.

The Parliament of Zimbabwe is in the process of introducing a new law for the registration and operation of companies in Zimbabwe which law will replace the current Companies Act. It will be called the Companies and Other Entities Act.

One of the most important features of the Bill is the introduction of an Electronic Registry for the incorporation and registration of domestic and foreign companies and private business corporations and The introduction of a continuous system of updating the Registry. This will make it easier to access documents relating to your company from anywhere in the world. This will finally help with the digitisation of the companies registry and the eventual establishment of an electronic companies registry which will supplement the paperbased one,which will help everyone to access it.

In addition, the Bill provides for manual or electronic service of documents in connection with legal proceedings under this Bill.

It will also allow any company register, index, minutes, financial statements and company documents to be issued or circulated by a registered business entity in the English language or in any officially recognised language provided that there will be a certified English translation provided to the Registrar.

Very interesting judgement on tax law.

Taxman not there to raise money for the State!!! '...The contra fiscum rule prescribes that the meaning that benefits the individual against the State Treasury should be adopted... in cases of doubt, the most favourable interpretation to the tax payer should be adopted. The mere fact that the Customs Officer, the Regional Manager, the Commissioner and the respondent could not agree as to which category the imported vehicle fell casts doubt on the customs officials’ classification of the motor vehicle...In conclusion, I am constrained to remark that in cases of doubt the main function of customs officials is not to make extra money for the State but to facilitate trade, hence doubts must be resolved in favour of the tax payer...'
