Are you married or in a civil partnership?

If we're married, we like to think it really will be happy ever after, but the reality of modern life is that a large proportion of marriages are likely to end in divorce. If this should happen, your ex-partner might have a claim on the assets you intended to leave in your Will for your children or other heirs.

While an equitable division is fair enough, the reality is sometimes actually disproportionate, for one reason or another. The best way of avoiding that and ensuring your estate goes to where you intended is to put it in a Trust.

Initial consultation meetings are now done by video and are free. A single Will is normally £125, and a double Will is normally £195, before the discount.

So what should I consider when making my Will?

Executors – the person(s) who will carry out your wishes and apply for Probate. You must trust them implicitly. A couple will generally choose each other, but consider reserves on 2nd death. Unless you have a complex estate there is no need to use a professional Executor like a solicitor.

Guardians – the person(s) who you trust to bring up your children should the worst happen to both parents. Important to name a Guardian in your Will to make your wishes known. Check with them first though.

Gifts – Often sentimental items that you want specific people to have, like your grandmother’s ring to your niece etc.

Age of Inheritance – legally you can inherit at 18, is this too young? Maybe 21 or 25 would be better.

Family Wipe Out Clause – consider if the immediate family was killed in an airplane crash. Who would you want to have your estate then?

Funeral Requests – Buried, cremated, ashes scattered at sea etc.
