👑 The recent King’s Speech revealed the Government’s plan to introduce the Border Security, Asylum, and Immigration Bill, aiming to tackle small boat crossings.
The Bill will strengthen border security with a new Border Security Command and harsher penalties for organised immigration crime.
It promises to modernise the asylum system, end the use of hotels by asylum seekers, and clear the backlog of 95,000 claims.
❌ The Government will halt the Rwanda scheme and implement fast-track returns for applicants from safe countries.
As of 6 August 2024, the Home Office has updated its guidance, allowing all BRP holders to create a UKVI account and access their eVisa anytime. This change allows you to prepare in advance for the digitalisation of immigration status.
⚡ Key Points:
Create a UKVI Account: All BRP holders can now create a UKVI account to access their eVisa. Previously, registration was only allowed after an email invitation.
Travel Requirements: eVisas will be valid for travel from 2025. Until then, you must travel with your physical BRP.
Update Your Details: Ensure your UKVI account details are accurate and up-to-date. Link your current passport to your eVisa, especially if you hold multiple passports. The passport linked to your eVisa must match the one used for travel, as airlines will verify your eVisa by scanning your passport.
How to Travel: Watch the Home Office information video on how to travel with your eVisa (How to Travel With Your eVisa—YouTube). It provides step-by-step guidance on checking and updating your details, including linking multiple passports for dual nationals. It may be necessary to upload documents for complex updates, like name changes. Such changes can take longer to process, so update well before your travel date.
Error Reporting: If you notice any errors or discrepancies in your eVisa, immediately report them to the Home Office. Resolution times can vary, so timely reporting is crucial.
❗ We have received enquiries from our clients about errors in their eVisas. If you encounter any issues, please reach out to us for guidance. We are here to help you navigate these changes smoothly and ensure your digital status reflects your actual immigration status correctly.

💭 If you are considering buying a property in the UK, there are some essential factors to consider. Here are some tips to guide you through the process:
🎟️ Attend the Ideal Home Show for inspiration and guidance on the latest technology, fresh ideas, and innovative products.
🕵🏼♂️ Conduct thorough research, especially since the competition and high demand can result in inflated prices.
🏠 Non-citizens and foreigners can purchase a property and obtain a mortgage in the UK. Still, it is advisable to work with a mortgage advisor and a solicitor based in the UK to handle legal documentation.
🛋️ Assess which type of house suits your needs - residential houses come in a wide range of styles throughout the United Kingdom.
💯 Take steps to make the process of buying a property in a foreign country smoother, such as calculating moving costs and mortgage options, finding the right property, viewing and making an offer, finding a solicitor, surveying the property, finalising the mortgage process, arranging insurance, signing and exchanging contracts, and finalising the move.
🙋 Seek help from professionals such as real estate agents, lenders, solicitors, and house inspectors.
📍 Consider location, transportation links, local amenities, and potential for rental income.
❗ Be aware of additional costs such as stamp duty, legal fees, and maintenance costs.
👀 Keep an eye on the property market and stay informed about regulation changes and interest rates. By following these tips and building a team of experts, you can make a safe and sound investment in the UK property market.
✔️ We have compiled a legal checklist for start-ups to ensure that you are always on the right side of the law.
🧱 Incorporation and Business Structure. Ensure that your company's registered office complies with the Companies Act 2006 and that your Articles of Association suit your business.
👨💼 Founder, Director and Shareholder Documentation. Ensure that founder and shareholder agreements exist and that all obligations and requirements for lawful directors and employees are met.
🎫 Licences, Authorisation and Permits. We advise you to speak to our legal team if you need any permits, licences or approval.
💸 Taxes and HMRC. Avoid getting on the wrong side of HMRC, which could lead to expensive fines and penalties. It's also advisable to consult an accountant who can help you with all your HMRC submissions.
🛡️ Data Protection and Security. Ensure you register with the Information Commissioner's Office (ICO) and comply with the regulations when storing, processing, and transferring personal data.
💼 Employees and Independent Workers. Be cautious when hiring independent workers as they may be deemed employees according to the law. Ensure all employment documentation is in place, including employment contracts, and that policies are in place to prevent disputes.
🧠 Intellectual Property. Register trademarks, protect information disclosures through a company NDA, and consider getting a patent for new inventions.
☂️ Insurance. Some types of insurance are mandatory, while others are optional but wise to have.
Starting and running a business is challenging, but getting the legal requirements right from the start can save you time, money, and stress in the future.
🛰️ Are you looking to expand your innovative technology business globally? Look no further than the UK government's Global Entrepreneur Programme (GEP). This program supports non-UK-based founders to help them establish and scale their business from a UK global headquarters.
🤝 GEP provides free mentoring and business support, including introductions to crucial networks and investors, guidance on international growth, and help from the Department for International Trade (DIT) for exporting. Accelerator participants are mentored by experienced entrepreneurs known as 'dealmakers' who have successfully set up, built, scaled, and sold technology companies.
💡 To qualify for GEP support, you must be an overseas-based entrepreneur and founder of an innovative technology business, willing to relocate and establish the company's global headquarters in the UK.
🦾 Your company must have a ground-breaking product or service based on unique technology, a business plan outlining how the business can expand from a UK headquarters, a customer-validated product in the market or ready to launch, and a clear commercial proposition addressing a large global opportunity.
🌍 The GEP has helped numerous companies, including DNAfit from South Africa, Nutmeg from the United States, and Seatfrog from Australia, to relocate to the UK and establish their global headquarters. The programme provides ongoing support through its Alumni Academy Programme, helping companies build capability in key business areas, scale up and fulfil their export ambitions, and make connections in the wider UK tech ecosystem.
⏱️ Take advantage of this opportunity to power your global success with the UK government's Global Entrepreneur Programme. Apply now and take your innovative technology business to the next level.
🇪🇺 For all EU nationals seeking to work, live, or study in the UK post-Brexit, you need to be aware of significant changes in the visa requirements.
❗ You must apply for a visa for those without pre-settled or settled status. Fortunately, a range of UK visa options is available for extended stays.
🌟 The most popular choice was the EU Settlement Scheme, which granted either pre-settled or settled status for EU nationals already living in the UK.
👨👩👦 For those looking to join their loved ones in the UK, the UK Family Visa is a viable option. The visa allows dependant family members, including spouses, children, and parents, to join their loved ones in the UK. Applicants must meet the English language requirement and have sufficient funds to support themselves and their dependants.
👨💼 The Skilled Worker Visa is designed for foreign nationals employed in paid work with a Certificate of Sponsorship from a UK employer. The Frontier Worker Permit is ideal for EU, EEA, or Swiss nationals working in the UK but living in their home country.
If you're an aspiring entrepreneur, the Innovator Founder Visa may be your perfect choice. It's for foreign nationals endorsed by an approved endorsing body to set up and run an innovative business in the UK.
🌠If you have exceptional achievements, the Global Talent Visa might be an option.
🎓 Finally, the Graduate Visa is designed for international students who have completed a degree in the UK and wish to work for up to 2 years.
❇️ Whether you're an entrepreneur or a student looking to start your career in the UK, there is a visa option available for you. We encourage you to explore your options and take advantage of the UK's opportunities.
👋 Happy World Consumer Rights Day! Today, we celebrate consumers' fundamental rights and their vital role in driving our economy.
🔄 This year, we mark the day with a significant legislative and regulatory shift that will impact businesses globally. With the introduction of landmark pieces of new digital regulation, including wide-ranging changes to competition and consumer laws, there is a need for consumer-facing businesses to stay on their radar and take proactive measures to remain compliant.
⚡ We want to highlight three crucial topics in consumer law for consumer-facing businesses to keep on their radar over the next 12 months.
1. Firstly, fines for breaches of consumer law are set to become more severe. This highlights the need for brands to review consumer contracts, user journeys and overall product compliance to avoid fines, regulatory investigations, and unwanted negative PR.
2. Secondly, the UK government is particularly focused on tackling subscription traps, and we expect the introduction of specific legal obligations on subscription providers to provide mandatory pre-contract information, send reminder emails to consumers before a contract auto-renews and ensure that consumers have a straightforward, cost-effective, and timely mechanism to terminate the subscription contract.
3. Lastly, addressing fake reviews is a significant challenge for businesses. The UK government plans to crack down on fake reviews online by obligating traders to take reasonable and proportionate steps to check reviews are genuine before they are hosted.
📢 As consumers become more informed and empowered, businesses need to step up their efforts to ensure compliance and protect the interests of consumers. Let us continue prioritising consumer rights and working together to create a fairer marketplace for all.
💚 Get ready to paint the town green! St. Patrick's Day is right around the corner, and we are all excited to celebrate Irish culture and heritage. This day is a time to gather with friends and family, eat delicious food, drink green beer, and enjoy the festivities.
🍀 For those who don't know, St. Patrick's Day is a celebration of the life of St. Patrick, the patron saint of Ireland. Legend has it that he used the three leaves of a shamrock to explain the Holy Trinity; thus, the shamrock has become a symbol of this special day.
🇮🇪 Although St. Patrick's Day is rooted in Irish tradition, it has become a global celebration. You do not have to be Irish to join in on the fun! Cities worldwide are hosting parades and events, but even if you cannot make it to one of these events, there are plenty of ways to celebrate at home.
🍻 Get in the festive spirit by searching for four-leaf clovers, indulging in Irish potatoes, and baking delicious St. Patrick's Day-themed desserts. And, of course, no St. Patrick's Day celebration is complete without a pint of your favourite Irish beer or a green beer if you are feeling extra festive.
🎬 If you are looking for a family-friendly activity, plan a crafty St. Patrick's Day afternoon and create some lasting memories with your loved ones. You could also gather to watch some Irish-themed movies, such as the beloved musical movie Once or the charming coming-of-age story Sing Street.
🎵 And remember the Irish step dancers! Catch a parade or festival performance and marvel at their incredible talent as they dance across the floor.
Whether you are in Ireland or halfway around the world, St. Patrick's Day is a day to come together and celebrate all things Irish. So put on your greenest outfit, raise a glass, and cheers to the luck of the Irish!
💗 In celebration of Mother's Day, we want to take a moment to honour and appreciate all the mothers juggling many roles with grace and strength. Being a good mum is a full-time job, but being a good lawyer, community member, and partner takes incredible balance and dedication.
🌸 At LS Legal Solicitors, we believe in supporting and encouraging that balance. We know that our employees are more than just their jobs and that family comes first. That is why we strive to create a workplace that feels like an extension of the family, where remote working is encouraged when needed.
🤱 We respect, trust, and care for each other as a team. And we are incredibly proud of our working mums, who know how to get things done even when juggling a million things simultaneously.
🐣 Being a mum is not always easy, but we admire how our mums handle it gracefully and resiliently. Some of our team members have shared their favourite quotes about motherhood to celebrate this holiday. One of our favourites is: "Being a mother is learning about strengths you did not know you had, and dealing with fears you did not know existed".
🧦 Another quote resonates with us: "That is what Mums do; they know, and they find things". Whether it is a lost sock or a missing document, our mothers always seem to have a knack for finding what has been lost.
🦸🏻♀️ So, here is to all the superhero mums out there. We see you, appreciate you, and are grateful for all you do. Happy Mother's Day to our team members here at LS Legal Solicitors, mothers throughout the London and the UK communities, and beyond! And remember, if you ever need a helping hand with legal needs, we are always here for you.
✨ Are you dreaming of working in the UK but wondering whether you need a degree to qualify for the Skilled Worker visa? Well, we have some good news for you! You do not need a degree to apply for this visa. The Skilled Worker visa is a points-based system, meaning you must meet specific requirements to be eligible.
📝 Firstly, you will need to have a job offer from a licensed sponsor. The job must be at or above the minimum skill level, equivalent to A-Level or a similar qualification. However, you do not need to hold a formal qualification as the skill level of the job is important. You must also be able to speak English to an acceptable standard.
✔️ You must be 18 or over and have a valid passport with at least one blank page. You must also have valid TB and ATAS certificates if necessary. You must meet the general security and suitability requirements and not be in breach of immigration laws. Your job offer must be a genuine vacancy, and your job must be eligible and meet the appropriate skill level.
📑 You must have a valid Certificate of Sponsorship for the job and be competent in English to at least CEFR Level B1. Furthermore, you must be paid a salary that equals or exceeds both a general salary threshold and the ‘going rate’ for the occupation. You must also have enough money to support yourself without relying on public funds and provide a criminal record certificate if required.
🎓 While on this visa, you cannot access public funds, be self-employed or work as a professional sportsperson. However, you can study, undertake voluntary work, and have dependents who can apply simultaneously or join you later.
🍀 In conclusion, you do not need a degree to qualify for the Skilled Worker visa. If you meet the requirements and criteria outlined above, you may be eligible to apply for this visa and start your dream job in the UK. Good luck!
🎉 We are thrilled to announce the introduction of the Innovator Founder route, which replaces the previous Innovator and Start-up routes. This new route is aimed at individuals who have a genuine proposal for an innovative business and sufficient funds to deliver it.
🆕 The Innovator Founder route aims to make the criteria more flexible, allowing more individuals to enter the UK and establish innovative businesses without the previously required £50,000 minimum funds requirement.
👔 This new route also allows for individuals to engage in employment outside the running of their business, provided that the secondary employment is in a skilled work of at least RQF Level 3 (high school leaver and above).
📋 Settlement will be possible after spending three years continuously resident in the UK under the Innovator Founder route. We will provide a detailed breakdown of the visa requirements for new applicants in a separate post before the changes come into place on 13 April.
👏 We are confident that the introduction of the Innovator Founder route will attract more innovative entrepreneurs to the UK, bringing new ideas and opportunities to the country's business landscape. We are excited to welcome new clients who will benefit from these changes and look forward to supporting them as they establish and grow their businesses in the UK.
📅 With the introduction of this new route, the Start-up route will no longer be open to new applicants from 13 April 2023, except for where they are supported by endorsements that were issued before 13 April.
😊 We are delighted with this news and are excited to support our clients in their journey to establish and grow innovative businesses in the UK.
🌱 If you have established a private life in the UK, the Private Life Visa may be your ticket to legally staying there.
⌛ The duration of stay necessary to qualify depends on individual circumstances, including age and length of residence. This means that you may be eligible for a private life visa if you have lived continuously in the UK for a minimum of seven years, are under 18 or between 18 and 24 years of age and have lived in the UK for more than half of your life. If you are 18 or older, you may be eligible if you have spent less than 20 years living in the UK but would face significant problems reintegrating into your home country.
👉 It is important to note that private life visa applications must be made within the UK.
📅 As of 20th June 2022, the immigration rules for private life visa applications have changed, introducing a new ‘Appendix Private Life.’ These new rules provide immediate settlement in the UK for children born in the UK who have lived here for seven years or more.
✅ Usually, for an adult to settle in the UK under the private life route, they must have completed ten years of continuous residence; however, in exceptional circumstances, the period required to gain settlement has been reduced to promote the welfare of children who have come to the UK. This change also introduced new validity, suitability, and eligibility requirements for applicants on the private life visa route.
🏠 The applicant must be in the UK when the application is submitted to the Home Office.
👉 It is important to note that private life visa applications may be refused on the grounds of suitability if you are subject to a deportation order or granting the visa would not be conducive to the public good.
🤝 The Private Life Visa route may be the solution to your immigration worries. Please speak to our immigration solicitors to assess your eligibility for a private life visa.
