The State has seized 35 houses and Sh95 million from ex-Kenya Rural Roads Authority staff Margaret Wanja Muthui in a corruption case. President Ruto previously accused the roads agency employee of using legal avenues to obstruct her transfer.
The High Court has now sided with the Assets Recovery Agency, affirming that the properties were indeed proceeds of crime.
Salaried workers in Kenya are celebrating a significant legal triumph as the High Court declares the Housing levy, part of the Finance Act 2023, unconstitutional. Justice David Majanja, in a ruling addressing petitions challenging the Finance Act 2023, stated that the levy violated Article 10, 2 (a) of the constitution.
During the judgment delivered on behalf of a three-judge bench, Justice Majanja emphasized, "We find that the introduction of the housing levy amendment to section 84 lacks a comprehensive legal framework in violation of Article 10 of the constitution. The levy against persons in formal employment without justification is discriminatory and irrational."
The court has ordered an immediate halt to further levy collections and declared sections 84, 72 to 78 of the Finance Act null and void. Justice Majanja stated, "An order is granted prohibiting the respondent from collecting, charging, or otherwise enforcing the charge known as the affordable housing act."
The housing levy, deducted from the salaries of formally employed Kenyans since July, was a significant component of the Finance Act, with the Kenya Revenue Authority (KRA) acting as the collecting agent. Both employers and employees were contributing 1.5 percent each toward the levy.
The government's intention behind the levy was to fund the construction of affordable homes for low-income Kenyans. However, the court's decision has put a stop to this deduction, marking a crucial victory for the rights of hardworking individuals.
The Finance Bill 2023, passed by parliament on June 22, 2023, and assented to by President William Ruto on June 26, faced legal challenges. The High Court initially suspended the act's implementation on June 30, following multiple petitions. The Court of Appeal lifted the suspension on July 29, leading to a hearing of the case on September 13.
A big shoutout to Busia Senator Okiya Omtatah and the six others who took legal action, seeking to halt the implementation of the Finance Act 2023.

Exciting Education Update!
The eagerly anticipated KCPE results are set to be revealed by next week, as confirmed by Education Cabinet Secretary Ezekiel Machogu. The completion of the marking process for the 2023 KCPE exam marks the closure of the 8-4-4 era in Kenyan primary education.
Machogu assured a swift release, facilitating the Form One placement exercise before Christmas and allowing parents ample time to prepare for January 2024 admissions. Children can be geared up for Form One by at least the third week of January, aligning with schools reopening on January 8, 2024.
This imminent release signifies the full transition from the 8-4-4 system to the Competency-Based Curriculum (CBC). Aligned with the 100 percent transition initiative, the shift aims to ensure all KCPE candidates seamlessly proceed to secondary school.
Machogu reported only six malpractice incidents during KCPE exams, emphasizing their minimal impact on the overall examination integrity. Looking ahead, the ongoing KCSE exams are set to conclude on Friday, with a 99.9 percent success rate in upholding integrity, thanks to enhanced measures like double paper collection.
The ongoing rains have impacted a total of 33 counties, resulting in the displacement or isolation of over 80,000 households due to the heavy downpours. According to Coast Regional Commissioner Rhoda Onyancha, the affected households in Mombasa, Kwale, Kilifi, Lamu, Tana River, and Taita-Taveta counties amount to 10,307. Ms. Onyancha's released statistics indicate that Tana River has the highest number of affected households at 5,136, followed by Mombasa with 3,892, Kwale (681), Kilifi (204), Lamu (305), and Taita-Taveta (89). In Wajir, County Commissioner Karuka Ngumo reported the destruction of several houses and the displacement of more than 30,000 locals.
Adult Kenyans including foreigners living in the country who are not members of the social health insurance fund(a new health funding model) will be denied access to government services once the social health insurance health act 2023 comes into force. This is part of the government's effort to drive compliance and generate revenue by targeting atleast 17million Kenyans above 18 years who are not members of the NHIF which is set to be replaced by SHIF to finance universal health coverage. Section 26(5) of the SHI act makes SHIF registration mandatory allowing the national and county government and their entities to deny services to those who are not members.
