Luxembourg Patrimoine a.s.b.l. s’engage pour la protection et la mise en valeur du patrimoine architectural au Luxembourg. L’association sans but lucratif Luxembourg Patrimoine qui s’est constituée le 03 novembre 2009, s’engage pour la sauvegarde du patrimoine bâti au Luxembourg. L’association constate que des immeubles dignes d’être conservés sont toujours démolis à un rythme soutenu, ceci surtou
t dans les zones urbaines. Afin de freiner cette évolution plus que regrettable et de donner une voix aux personnes partageant la même vue, l’association a été créée afin de se mobiliser ensemble contre une destruction aveugle du patrimoine culturel bâti de nos villes et villages.
1) La protection du patrimoine architectural en général : information et sensibilisation
La vue sur notre patrimoine architectural doit se faire à plusieurs niveaux : il s’agit d’abord de considérer l’impression générale qu’offre une ville, un quartier ou un village. Viennent ensuite les ensembles architecturaux et les bâtisses à conserver et la vue sur les détails d’un immeuble ancien, digne de conservation. Il s’agit donc :
a) de conserver une impression d’ensemble, le «cachet», l’originalité d’une ville et des ses quartiers
b) de reconnaître et d’apprendre à «lire» et à conserver des valeurs architecturales
c) de sensibiliser à la protection des détails architecturaux à l’intérieur et à l’extérieur d’un immeuble. Il semble d’autant plus important que l’information et la sensibilisation sur les valeurs culturelles du patrimoine atteignent aussi bien le propriétaire privé que les décideurs publics. Une conservation durable de notre patrimoine architectural n’est réalisable que si les propriétaires sont avertis sur la valeur architecturale de leur immeuble.
2) La refonte et l’adaptation complète des Plans d’Aménagements Généraux (PAG) des communes conformément à la loi modifiée du 19 juillet 2004 (modifiée par la loi du 28 juillet 2011 concernant e. les contenus de l’étude préparatoire et des plans d’aménagements généraux)
Il y a maintenant 75 ans que les bases pour une protection du patrimoine architectural au niveau communal ont été créées (loi du 12 juin 1937 ; publié le 07 août), avec une loi intitulée “L’aménagement des villes et autres agglomérations importantes“. L’Art 1 dit “Toute localité de 10.000 habitants et au-dessus est tenue d’avoir un projet d’aménagement. La même obligation incombe aux localités en voie d’accroissement, aux stations balnéaires et aux agglomérations présentant un caractère pittoresque, artistique ou historique”. Sous le point c) de l’Art 2 on peut lire “Les projets comprennent un plan avec un programme d’extension, déterminant les servitudes hygiéniques, archéologiques et esthétiques que comportent les différents quartiers“. Plus récemment, dans le contexte de la loi du 19 juillet 2004 (modifiée par la loi du 28 juillet 2011) concernant la refonte et l’adaptation complète des Plans d’Aménagements Généraux (PAG), les communes du pays sont invitées à actualiser leurs plans d’aménagements ceci au plus t**d pour le 08 août 2013 (“Les projets d’aménagement général faisant l’objet de la refonte complète, prévus à l’alinéa 1, doivent être soumis à l’accord du conseil communal conformément à l’article 10 alinéa 2 jusqu’au 8 août 2013.“). Dans ce contexte, Luxembourg Patrimoine asbl est d’avis qu’il est d’une importance capitale que les responsables communaux établissent rapidement un inventaire des immeubles et ensembles architecturaux à conserver afin de pouvoir les identifier et classer ensuite comme «zone protégée» ou «zone sensible» dans leurs PAG respectifs. La conservation durable de l’identité visuelle, architecturale et culturelle d’une ville, d’un quartier ou d’un village est seulement réalisable par ce biais. Il n’est pas suffisant de dessiner un «cercle d’alibi» minimaliste autour du vieux noyau! Il faut considérer toutes les époques de développement d’une ville, d’un quartier ou d’un village avec leurs spécificités et identités architecturales, sociales et culturelles qui leurs sont propres. Un facteur rendant plus difficile une approche unifiée par rapport à la conservation du patrimoine architectural (extérieur et intérieur !) au niveau national est aussi dû au fait que différents Ministères concernés c’est-à-dire le Ministère de la Culture, dont dépend le Service des Sites et Monuments Nationaux, et le Ministère de l’Intérieur dont dépendent les communes, utilisent des terminologies et concepts différents issus de contextes (législatifs) différents – même si avec la loi modifiée du 28 juillet 2011, des critères communs existent heureusement dorénanvant pour les deux acteurs (“authenticité de la substance bâtie, de son aménagement, rareté, exemplarité du type de bâtiment, importance architecturale, témoignage de l’immeuble pour l’histoire nationale, locale, sociale, politique, religieuse, militaire, technique ou industrielle“). Ainsi, la législation à disposition du SSMN connaît deux formes de protections, à savoir «les immeubles et objets classés monuments nationaux» et «les immeubles et objets inscrits à l’inventaire supplémentaire». Au niveau communal par contre, on parle de “secteurs protégés d’intérêt communal”, voir de «zone protégée», «zone sensible», etc. Luxembourg Patrimoine est d’avis qu’il est urgent et indispensable d’harmoniser les concepts et cadres législatifs sur ces points afin de clarifier la portée exécutoire et d’assurer une meilleure efficacité des moyens légaux mis à disposition pour la protection du patrimoine architectural, ceci indépendamment de la situation géographique et/ou politique d’un certain lieu ou région.
3) Financement de notre patrimoine architectural
La question du financement de notre patrimoine architectural n’est pas uniquement une question de subsides pour la restauration. En fait, il s’agit d’apporter une réponse à la question de savoir pourquoi certains puissent rentabiliser la destruction d’un immeuble digne de protection pour réaliser une plus-value avec la construction d’un nouvel immeuble au même endroit, tandis que d’autres, au nom de la protection du patrimoine (dans l’intérêt de la communauté, donc de nous tous!), ne peuvent pas procéder de la même façon et sont contraints de renoncer à des bénéfices potentiels. En plus, les travaux de conservation et d’entretien de leur objet sont en grande partie à leur charge. Luxembourg Patrimoine propose ainsi la création d’un «Fonds du patrimoine»;. Ce fonds serait alimenté par le versement d’un pourcentage prédéfini sur le gain qui a été fait suite à chaque nouvelle construction immobilière, une sorte de «taxe pour le patrimoine». Les propriétaires d’un objet digne d’être conservé et qui soignent et sauvegardent volontairement – ou sont obligés de sauvegarder – leur objet, pourraient être indemnisés par ce fonds pour une partie des surcoûts et du manque à gagner qu’ils doivent supporter. Cette mesure rendrait la conservation du patrimoine bâti également plus attractive d’un point de vue économique.
4) Patrimoine architectural et «passeport énergétique»
L’introduction du «passeport énergétique» pourrait se révéler destructrice pour le patrimoine bâti. Même s’il est clair que l’intention de vouloir économiser l’énergie est une idée juste et durable, Luxembourg Patrimoine pointe néanmoins du doigt le risque encouru par l’application d’un même standard pour des objets qui ne sont pas comparables en soi. Ainsi, la loi n’oblige pas non plus les propriétaires de voitures «oldtimer» de les équiper d’airbags, de moteur plus propres, d’un système de freinage «ABS», avec comme seul argument que le progrès technique doit impérativement déclasser d’autres valeurs! Luxembourg Patrimoine est d’avis qu’il faut rapidement chercher et appliquer des solutions techniques pour augmenter la performance énergétique, mais des techniques adaptées permettant de restaurer et conserver ces immeubles anciens dans le respect le plus complet de leur identité architecturale. Ainsi, Luxembourg Patrimoine propose d’introduire une classe énergétique «P» (comme «Patrimoine») supplémentaire pour le passeport énergétique obligatoire. Chaque immeuble ancien et digne de conservation pourrait donc être analysé par des experts du patrimoine bâti afin de définir les mesures d’amélioration du bilan énergétique compatibles avec la conservation dudit immeuble et se verrait attribuer un passeport énergétique classe «P». Par la même occasion, un nouveau marché de la rénovation énergétique pour des immeubles historiques pourraient y trouver son compte, ainsi que les corps de métiers spécialisés oeuvrant en la matière. A la fin, le vendeur d’un immeuble historique pourrait lui aussi faire valoriser son investissement qu’il a fait pour l’augmentation de la performance énergétique de son objet.
5) Revalorisation de l’image de marque et campagne de sensibilisation
Pour une partie de la population, il persiste l’idée préconçue qu’habiter un immeuble ancien pourrait être inconfortable et cher quant à l’entretien. Afin de contrer ce préjugé, Luxembourg Patrimoine réclame au niveau politique une campagne de revalorisation d’image afin de mettre en évidence l’importance qui relève de l’entretien et de la restauration d’immeubles et de monuments d’intérêt historique et architectural et les avantages de leur exploitation comme espace d’habitation de style et de confort. Luxembourg Patrimoine se veut être un catalyseur pour les 5 grands thèmes développés ci-avant. Ces objectifs ne seront atteints que si tous oeuvrent dans la même direction. Luxembourg Patrimoine propose sa bonne collaboration aux ministères, communes, associations et particuliers qui s’engagent pour ou s’intéressent tout simplement au patrimoine architectural.
