We are pleased to report another appellate victory for Conway, Donovan & Manley, PLLC!

The United States Court of Appeals for the Sixth Circuit affirmed the Southern District of Ohio's determination to deny Cavalier Distributing Company, the Plaintiff, a preliminary injunction because they were unlikely to prevail on the merits of their claim. In relevant part, the Plaintiff had alleged that our client Lime Ventures had violated the Ohio Alcoholic Beverage Franchise Act when it entered into a distribution agreement with Cavalier Distributing Company’s competitor. This was a classic team effort – Lauren Mordacq and Ryan Donovan wrote a persuasive Respondent’s Brief and Ryan Donovan presented oral argument. See the Court's decision below:

The Conway, Donovan & Manley, PLLC Team is happy to announce last week's win before the Appellate Division, First Department.

At the trial level, we successfully moved on behalf of our North Carolina based client to dismiss the plaintiffs' complaint for lack of personal jurisdiction.

In the linked First Department Decision and Order, the Court upholds the Supreme Court's determination to dismiss the complaint, rejecting plaintiffs' conspiracy jurisdiction theory under CPLR 302(a). Kudos to Ryan Donovan and Lauren Mordacq, whose teamwork successfully opposed plaintiffs' conspiracy theory arguments resulting in a win for our client at the Appellate Division.

CDM is a busy downtown Albany law firm focusing on commercial and personal injury litigation. This position will require approximately 16 to 20 hours per week, generally working from the hours of 10 a.m. to 2 p.m. The ideal candidate should possess strong organizational skills, be experienced with computers, including Microsoft Word and online filing, and must be willing to pitch in when needed. Prior experience in law firm preferred but not required. Compensation will be commensurate with experience, and parking is included.
