HOAs and Rentals (AB 1410)
π Back in 2020, legislation was enacted that limits
the ability of an HOA to restrict rentals within their association. Under that law, HOAs must allow at least 25 percent of units to be leased or rented by their owners.
π Since that time, there had been some confusion as to how this
impacts an ownerβs ability to rent out just a portion of their property, such as a room or an ADU.
π This new law makes it clear β properties where the owner lives on site and rents or leases just a portion of their property do not
count toward the allowable 25 percent cap.
π Furthermore, this law specifi cally bans HOAs from prohibiting an ownerβs ability to rent a portion of their property while the owner lives on site, as long as the rental period is for 30 days or more.
π HOAs continue to have the right to restrict or prohibit all or any portion of a property in the association from being used as a
short-term vacation rental.
