Lashawn Denise Bagley, 23, was previously charged with murder in connection to the 2022 death of Demetrius Allen, a bull rider who performed under the name Ouncie Mitchell.

The incident was initially investigated as a domestic violence homicide. Detective Michelle Peterson previously said Allen was trying to collect belongings from Bagley’s apartment on Sept. 12, 2022 when he was shot by the woman. Allen was found in Bagley’s apartment with gunshot wounds and was taken to a local hospital where he later died.

Last week, Judge Mark Kouris ruled that Bagley was justified in the shooting. Kouris noted that Bagley had the legal right to defend her home.

Bagley’s charges, including nine counts of felony discharge of a firearm, one first-degree felony, and eight third-degree felonies, were dismissed.

“She was justified in shooting the gun,” Kouris said during a justification hearing.

During the hearing, Salt Lake Police Detective Nathan Wiley testified that Bagley called 911 on the night of the shooting because she thought her home was being invaded.

Bagley had left her home with Allen and a second woman at 9:30 pm to go to a club and returned alone around 11:30 pm. She made a disturbance call to dispatchers just after midnight. More testimony showed that Allen and the woman tried to enter Bagley’s apartment twice, once with the credit card and another time with a rock.

“LaShawn owned the gun. She had every right to protect herself in her own house,” Defense attorney Sherry Valdez said.

Salt Lake County Deputy District Attorney Andrew Deesing argued that Bagley didn’t have “reasonable fear,” citing text messages between her and Allen where he said he was coming to get his belongings from her home.

The judge, however, said Bagley only needed to perceive a home invasion to justify self-defense.

A 23-year-old mother in Florida was killed by her younger brother Sunday during a family dispute over Christmas gifts, authorities said.

The argument began as Abrielle Baldwin, her two sons, ages 6 and 10 months, were out shopping Sunday night with her two teenage brothers, ages 15 and 14, and their mother, Pinellas County Sheriff Bob Gualtieri said.

Baldwin’s 14-year-old brother was apparently upset that his older brother was getting more gifts than he, sparking an argument, the sheriff said.

“So they had this family spat about who was getting what and what money was being spent on who,” Gualtieri told reporters Tuesday.

The family eventually left the store and went to Baldwin’s grandmother’s home, where the arguing continued.

While at the residence, the 14-year-old took out a handgun and threatened to shoot his older brother in the head, authorities said.

Family members present at the home tried separating the teens. The younger teen then began arguing with Baldwin and threatened to shoot her and her 10-month-old son.

He then allegedly shot her in the chest with a .40-caliber handgun. The baby was in a carrier and wasn’t harmed. When the 15-year-old teen came out of the home, he took out his own .45-caliber handgun and shot his brother in the stomach.

The older teen ran from the scene and tossed the gun, Gualtieri said. The younger teen who allegedly shot Baldwin was hospitalized in stable condition and will be taken into custody when he’s released.

Local prosecutors will review the case and decide whether to charge him as an adult for the killing of his sister, the sheriff said. The 15-year-old was arrested and charged with attempted first-degree murder and tampering with evidence.

A convicted felon has been shot dead by law enforcement after attacking a Florida deputy with a rod and burning his girlfriend’s 9-year-old son because he believed the child was “possessed by a demon,” authorities said.

First responders who arrived in the city of Sebring for a report of a suspicious roadside debris fire around 4 p.m. Tuesday were confronted by 39-year-old Richard Ham brandishing a pair of metal poles, according to a press release from the Highland County Sheriff’s Office.

Ham and his girlfriend, Lakenya Phillips, 30, had been torching the possessions of the woman’s 9-year-old son, whom the man thought to be “possessed by a demon.”

Witnesses told investigators that Ham pushed the boy into the fire and covered him with a flaming blanket, but the child managed to escape without serious injuries.

Deputies who raced to the scene ordered Ham to surrender, but he allegedly refused to comply with their commands, prompting them to tase him.

The Taser, however, appeared to have no effect on Ham, who struck a deputy with one of the rods in his hands, the sheriff’s office stated.

A deputy then opened fire on Ham and mortally wounded him. The suspect was taken to a hospital, where he later died.

The officer who was bludgeoned in the head was treated at another hospital and released.

Meanwhile, cops arrested Phillips, who had been listed along with her son as missing and endangered out of Wichita, Kansas, two weeks ago.

It is unknown how or why the two ended up nearly 1,500 miles away in Sebring, Florida.

The woman’s son, who is in the custody of the Department of Children and Families, said he had not bathed or brushed his teeth in at least 10 days, and had not been fed for at least 24 hours.

According to the 9-year-old, both his mom and her boyfriend had regularly used drugs, and he said Ham had threatened him with a large knife, which he claimed “he had used to kill someone,” officials said, adding that they were working with colleagues in other states to follow up on that statement.

Multiple guns and drugs were found in the vehicle Ham and Phillips were traveling in, the sheriff’s office said.

Phillips was subsequently charged with attempted murder of a law enforcement officer, battery on a law enforcement officer, resisting arrest with violence and cruelty toward a child. During her initial court appearance Wednesday, prosecutors told a judge they will also be seeking a felony murder charge against Phillips, claiming that her actions contributed to Ham’s death. She was ordered jailed without bond.

Ham had an extensive criminal history that included convictions for armed felonies and drug possession in Arkansas, South Carolina and Georgia.
