NIL is the new "gold rush" and shows that prospectors are entering territories that each have different rules with different consequences. In Colorado, there are no prohibitions on working with brands in "specific categories." In Texas, however, student-athletes are not permitted to profit on their NIL for "sports betting" or "casino gambling," among other restrictions. Still, even for these deserving Colorado athletes, the article reports that "University of Colorado's compliance office says they are waiting on the university's counsel to advise them as to whether MaximBet's offer would be considered a conflict for their student-athletes under section 3(a) of the state law due to the University's deal with PointsBet."
Until Congress or the NCAA promulgates rules for national standards, student-athletes would be well-served seeking professional advice before accepting any NIL benefits.

The NCAA has taken a hands-off and permissive approach to NIL, allowing schools in states that do not have NIL laws to set their own policies. Utah has no law, but the NCAA still does not allow NIL payments to be used as recruiting inducements or pay-for-play.
