Remember, if asked to give a statement relating to a possible criminal charge, refuse to answer any questions without the presence of your lawyer. You have a constitutional right to remain silent, so exercise that right..

I am asked about Miranda rights in a DUI stop. There is no requirement when first stopped but after being arrested you are given your rights and if you exercise them then all questioning must stop..If it doesn't and you respond those responses cannot be used by the prosecution in the case in chief.

Questions are frequently asked of me regarding "road side field sobriety tests" in DUI stops.. Tests are rarely completed satisfactorily for the officer instructing the driver accused and it only makes for additional evidence against you.If you believe you are under the influence,
then I would suggest a polite refusal..
The refusal on the "breath test" may have serious consequences separate and apart from the DUI investigation.

Mutual cross-petitions for restraining orders can be resolved with a civil settlement, in lieu of the possible repercussions that one can have if there is a violation of that restraining order..

Florida injunctions are enforceable in all counties of the state as well as nationwide..Similarly, qualifying final orders of injunction issued by foreign state courts are enforceable in Florida and enforced by our law enforcement as well.

I spent 9 plus hours in a mediation last Friday on a negligent security case and the lawyers and the mediator were very organized and very professional..I have often thought that mediation in minor criminal cases would work very well also and would help to eliminate the huge case count in some of the divisions.
