When you go to Circuit Court ⚖️ for the purpose of an Order to buy and/or sell real estate, the property has to be sold for the APPRAISED VALUE, AT MINIMUM! 💵 (This does not apply to foreclosure matters.)
You will not be able to buy or sell the property for pennies.

When multiple people own real estate 🏡 , ALL of them are responsible for taxes, insurance, upkeep, etc.
It doesn’t matter who lives in the house. ‼️
Putting real estate 🏘️ in a Trust doesn’t save you from having to answer the following questions:
* Who is going to pay the mortgage/taxes/insurance?
* Who is going to maintain the property?
In order for the “Trust” to do this, there must be something income producing in the Trust.
Also in SC the property is not conveyed to the Trust, it is conveyed to the Trustee on behalf of the Trust. (This means one person is still in “control” which is usually what parents of multiple children are trying to avoid. However, you can name a bank/financial company as Trustee.)
Properties placed in Trust can be and are still sold at Tax Sales and Foreclosed on! ‼️

Heir Property Lesson for the Day: 🏘🏠
Lots of people have an idea of what affects interest in real property. Many times, those ideas are wrong.
The following are quotes that I heard in Court yesterday:
1) "My mom helped my sisters get their own houses."
2) "My mom paid for my sister's funeral."
Neither of those remove someone's interest in real property. Even if a parent "helped" one child more than another or paid for someone's funeral, that doesn't mean they or their heirs no longer have an interest in the property. I was somewhat blown away by those statements yesterday. SMH
Also, it doesn't matter who took care of whom in life and/or in their last days, who is the oldest, who is the youngest, etc.

The recent NAR ruling came up in my 🏘🏡🏠 real estate hearing today! 😳😲
I had an Heir Property/Partition Hearing this morning in Greenville County. The property will be sold in a private sale and listed with a Realtor. In these cases the Judge can set the realtor's commission. In discussing this on the record the recent NAR ruling came up. The judge ordered that commission be capped at 6% which was the previous "standard."
Also, this house was condemned by Greenville County in September of 2023 and on March 11th at 9:17 PM I had to file for an Injunction to save the property from demolition, just to get to the hearing today and allow the property to be sold. 😒

Real Estate Litigation Tip of the Day: 🏠
Both Quiet Titles and Partition Actions for Heir Property are LAWSUITS! They are not just someone signing a piece of paper. I always tell people not to get mad at their family members. The case is procedural, not personal!
Also, these cases become more costly and lengthy the more you wait because over time more people pass away and then their heirs are now included. Therefore, not doing anything now makes it worse for the next generation.

Remember, if you buy property at the county tax auction, and/or purchase property from someone else who did, you will likely need to do a Quiet Title.
Without a Quiet Title, you cannot get a construction loan, you cannot get title insurance, and you cannot sell to a buyer who requires a loan to purchase the property.
The process requires very little on your part. We just need the property address or tax map number to get started. And payment of course!

We received this email today from first time clients that came in just yesterday. They were a referral from a fellow attorney.
The parties entered into a Contract for Deed agreement many years ago and the buyer was making her last payment and therefore now needed title to the property. The parties drove to our office from Shelby, NC and Spartanburg. The property is located in Spartanburg.

Today we received a call from a daughter who's mother has a brain injury as a result of heart attack. Unfortunately, the daughter now is faced with the need to do a Guardianship & Conservatorship over her mother, in order to access her mother's funds to pay mounting bills. This is because her mother did not have a Durable Power of Attorney.
Trust me when I say, it makes more sense to spend a couple HUNDRED dollars now, than to spend THOUSANDS later.
Also, a Guardianship & Conservatorship comes with the following:
* Having to get a SLED background check and a credit check
* Having to post a bond
* Having to set up a Restricted Bank Account
* Having to move money to a bank that will handle a Restricted Bank Account (Many will not)
* Having to have Court approval to spend money on almost everything
* Having the Court monitoring the bank account forever
* Having to file ongoing account with Probate Court
* Having a social worker, GAL, and/or an Attorney appointed that you have to pay for (in addition to your own Attorney)
