the difference between a patent and a trademark? They are both types of intellectual property but do very different things. A patent gives its owner the legal right to exclude others from making, using, or selling an invention for a limited period time, while a trademark protects a recognizable word, design, or expression which identifies the source of a particular product or service.
As an example: the first computer was patented as an invention, but the logo is a trademark!
Many people believe they need an attorney’s services only to solve a problem or to get out of a difficult situation after that situation occurs. The best time to see an attorney is not when you already have a legal problem, but instead well ahead of time to make sure you’re doing everything possible to avoid legal trouble down the road. Preventive law is one of the most valuable services that a lawyer can perform. By eliminating potential problems, preventive law can save you time‚ money‚ and needless worry. Reach out to us if you have questions or are even thinking about next steps in the process!

Ever heard of a cease and desist letter but never quite knew what it meant? When talking about a C&D, it’s important to know not only what is it, but when to seek one out, and how to use it effectively. Working with an experienced lawyer that is familiar not only with Intellectual Property law but also has a good understanding of your business will help you decide if a C&D is right for your situation.

Selecting a new trademark for your business isn’t always easy, but it helps to understand what qualities make a strong (i.e., unique and legally protectable) trademark. When it comes to trademarks, the weirder, the better. Try to think of terms that are not existing words (“fanciful” or “coined” marks), and stay away from merely descriptive words, as those are less memorable and less likely to pass USPTO muster during the trademark registration process.
