As advocates for our veterans, we want to share this information but emphasize that this situation is still very fluid and a rapidly evolving topic. The final settlement still needs to be approved by a judge. At VAREP we will continue to monitor the situation and provide updates as we know more.

Here is what we understand from the attached circular:
1. A Veteran buyer can pay the broker agent commission on the purchase side.
2. VA is still encouraging the Veteran to negotiate the commission.
3. This fee is NOT considered a concession which is good as it will not tap into the 4% concession limitation.
4. This is temporary, not permanent, and begins Aug. 10TH. Any loan closing prior to this date the Veteran will not be allowed to pay the commission.
5. VA will require the Lender to upload the Broker-Agent commission form with the purchase and sales contract at the time of the appraisal order. The negotiated contract must be in the file, and lenders will need to keep these on file.
6. VA is looking at how this will affect the real estate industry and what will be normal and consistent in the future of the industry.

What is VAREP doing to advocate for our veterans?
• Monitoring and assessing changes as they are released.
• Providing feedback when requested.
• Meeting with the VA at our upcoming legislative conference.
• Meeting with lawmakers to discuss the impacts on veterans.
