ADU’s or “accessory dwelling units” are looked at as one solution to our affordable housing crisis: whereby individual homeowners can do their part by building a new rental unit on their own property with minimal impacts on our utility infrastructure and community identity. Think of basement apartments or backyard cottages. Some aspects of this human-scale growth certainly have advantages over big disruptive developments that dramatically change a neighborhood or natural area. One of the best features is that the owners live with the consequence of their choices: the greatest impact of the ADU will be on the owner. This is starkly different than the situation in which a developer does a hit and run on a neighborhood in which they never intend to live.

The city is currently proposing to ease ADU building standards in order to get more built. Right now the city is taking feedback on their specific changes such as increasing the allowable size and relaxing parking requirements. We are very concerned that among their recommendations that they are proposing to do away with the owner-occupy rule and that they are not putting in a prohibition against vacation rentals (Airbnb’s).

Without an owner occupy rule, it will incentivize investors to buy single family homes (SFH) and build an ADU as a second investment property - competing with potential homebuyers and turning SFH into investments. And making an ADU into a vacation rental does nothing to solve our affordable housing crisis - which is what this change is purported to do.

If the city is going to deregulate zoning - which is essentially what this ADU and the upcoming radical “Upzoning” proposal would do - we should only do so if it results in actually affordable long-term housing.

Unfortunately, the city is buying into the “magical thinking” that any new housing supply will stabilize our housing prices. This ADU proposal will simply incentivize investors to turn our SFH neighborhoods into investment vehicles.

A compromise position may be to put in a “deed restriction” that it must be owner-occupied for the first 10 years, so that it takes away the short-term profit motive for investors but also allows owners, who may legitimately want a space for extended family or a new source of rental income, long term flexibility.
