Legal Lingo 101 - what is litigation? Litigation is the formal process of taking a dispute to court to be resolved by a judge or jury. 👨⚖️ This can involve situations like a broken contract, an injury caused by someone else's negligence, a disagreement about property ownership, or claims of medical malpractice.
The litigation process itself can be lengthy and complex. Before a trial even happens, there's a pre-trial phase where evidence is gathered, information is exchanged, and sometimes attempts are made to settle the dispute outside of court. If a settlement isn't reached, then the case goes to trial. 🏛️ Here, each party presents their arguments and evidence, aiming to convince the judge or jury of their position. Finally, a verdict is reached, which is the court's decision on the case. There may even be further legal steps after the verdict, such as appeals or enforcing the court's ruling.
While litigation is a common way to resolve disputes, negotiation, mediation, and arbitration are other options. Choosing the right path depends on the specific situation, what outcome each party desires, and their willingness to compromise. Your attorney will be there to guide you through the process of which dispute resolution option will be best for you and your case. ⚖️
