New NLRB Joint Employer Standard: Implications for Franchising
On October 27, the NLRB introduced a significant amendment to the joint employer standard, which has pivotal implications for franchise operations.
Revising the more narrow 2020 rule, the 2023 standard potentially expands joint employer status in collective bargaining contexts, particularly affecting franchise systems.
The crux of this update lies in defining entities as joint employers if they possess the authority to control “essential terms and conditions of employment,” including wages, work schedules, and safety protocols, among others. Notably, the rule now encompasses both direct and indirect control—or even reserved authority—over these conditions, diverging from the previous requirement for “substantial direct and immediate control.”
This change could inadvertently encumber franchisors with new liabilities, particularly in maintaining brand consistency and compliance with regulations, without crossing the threshold into joint employer territory. As franchise agreements necessitate certain controls for brand integrity and operational standards, the rule’s broad language presents a dichotomy: franchisors must navigate between ensuring brand uniformity and averting joint employer status.
Industry advocates, such as the IFA, have voiced concerns, emphasizing the rule’s discord with established FTC franchising regulations and its potential to stifle franchisee autonomy.
It's paramount that franchise systems examine their current agreements and operational directives to align with the NLRB's new standard. The business community and Congress must scrutinize this rule to safeguard the franchise model’s equilibrium between brand cohesion and franchisee independence.
