“There is still a lease to transfer and Skyline is the valid holder of the lease,” Lepizzera wrote. “Otherwise, the Board of Park Commissioners would not have placed the matter on its docket for consideration. In other words, if Skyline had no lease, there would be no lease to transfer.”

Lepizzera explained that despite the setback, Skyline is still open for business. He said he’s working to resolve differences between the parties before a trial date in R.I. Superior Court in March and is optimistic a resolution can be reached “amicably.”

“If that does not happen, each party has legal recourse for the courts to decide its differences,” Lepizzera said. “I am likewise optimistic of Skyline’s legal rights if the judicial process is required to sort out the legal issues.”

Our appeal has been filed and accepted. Eviction is now vacated. Skyline at Waterplace is open for business as promised. We look forward to serving our customers and having our day in court.

We had another wonderful event this past Saturday during the Veterans WaterFire. Skyline at Waterplace salutes all of the Veterans who have faught so hard to keep us safe. This is our 7th Veterans WaterFire being the gateway to the City of Providence - 1000’s of people have chosen Skyline to have their events and we look forward to 1000’s more - GOD Bless America 🇺🇸

I represent the tenant, Skyline at Waterplace, LLC, in this eviction proceeding.

Skyline is unequivocally appealing today’s decision. The appeal will be filed within the next 48 hours. That appeal goes to the Superior Court which will grant the parties a de novo hearing. This essentially means that the filing of the appeal to Superior Court automatically vacates the court’s decision today and the parties start anew in the Superior Court. If it comes to it and if necessary, there will be a trial on the merits which will now be in Superior Court as opposed to District Court. The parties deserve to be heard on the merits of their respective claims. In the event a trial is necessary, Skyline is confident that it will prevail leaving Skyline with 13+ years left on the lease term to continue to host premier events at this iconic venue which it physically built and created for the benefit of the City.

*OFFICIAL STATEMENT OF SKYLINE AT WATERPLACE*

I represent Skyline at Waterplace, LLC (“Skyline”) who is the long standing tenant of One Finance Way, Providence, Rhode Island pursuant to a lease with the City of Providence (“City”).

According to the written lease between the parties, Skyline has the unequivocal contractual right to exclusively occupy and operate its premier waterfront events venue in downtown Providence. That contractual right extends for an additional 14 years as the lease expiration date is February 28, 2037.

Despite the clear language of the lease and the conduct of the parties over this long term relationship which included Skyline renovating a completely gutted building at its own expense well exceeding $1,000,000, the city has decided for some inexplicable reason to file an eviction complaint. Notably, the complaint does not allege that Skyline has failed to pay the rent due under the lease. Instead, the city has manufactured dishonest reasons to move forward with its complaint for reasons other than non-payment of rent. Those reasons are flat out erroneous, wrong and form absolutely no legal basis to evict Skyline. In fact, there is another material flaw in the city’s complaint. The complaint alleges that the parties amended the lease three (3) times by agreement. While that statement is true in the sense that there are three (3) lease amendments, it is incomplete and misleading since the parties amended the lease on a fourth occasion.

Attached hereto is a copy of my March 13, 2023 letter to the City which refers to that Fourth Amendment to Lease with notice that the City owes Skyline $54,134.00 for overpaid rent. Therefore, not only will Skyline respond to the complaint by vehemently denying the frivolous allegations, but it will also be filing its own complaint against the City for the return of tens of thousands of dollars of overpaid rent and any other damages flowing from the filing of this baseless complaint.

Skyline is more than confident that it will prevail on the merits of its claims and looks forward to deposing and questioning under oath the City representatives and officials who are familiar with the parties’ agreement (including the fourth amendment) and who authorized the filing of this bad faith lawsuit. The hollowness of the city’s complaint demonstrates a hidden motive by the City for trying to terminate a lease without any supporting legal or factual basis and to wrongfully repossess a building that has been completely refurbished by and at the expense of Skyline with improvements well exceeding $1,000,000. The City is seeking to be unjustly enriched at the expense of the tenant and is completely wrong and unjust.

In the meantime, it will be business as usual for Skyline by continuing to service all its customers and serving as the host venue for both small and large scale parties and events. Business will continue on at One Finance Way in Providence for Skyline without interruption while the lawyers conduct the parties’ legal business in the courtroom.
