News reports are increasingly highlighting the issue of innocent people being wrongfully accused of DUI across the country despite being completely sober. A common factor in these cases is not intoxication, but rather underlying medical problems.

Field sobriety tests are designed to fail, judged by someone assuming you will fail from the start. Picture an Olympic gymnast being held to the same standards as a 45-year-old office worker—equally unfair. Their accuracy is dubious due to subjective evaluation, physical and environmental factors, and a lack of scientific backing, leading most sober motorists to fail. Law enforcement doesn’t allow practice. During a trial, attorney Bruce Edge asked an officer to demonstrate standing on one leg, who then put his foot down and asked to try again. Bruce then asked the jury, "Did you let my client do it again?" Scoring 75% on the heel-toe test is enough to get you arrested. The takeaway is that once you're pulled over, they often assume guilt, rarely letting sober drivers go.

A bartender from the New York hotel where Justin Timberlake was before his arrest confirmed that he had only one drink. In New York State, it would be completely legal for Justin Timberlake to drive after consuming one drink. It would only be illegal if he were over the limit. Often, police officers make subjective observations and jump to conclusions to secure arrests. The police are not usually objective in determining if someone is indeed impaired and often cut and paste clues and observations from one police report to another. This means that Justin's impairment clues or observations were probably close to, if not identical to, those of the last person the officer arrested for impaired driving. In this day and age, any smell of alcohol on your breath often means you are going to jail, even if you've only had one martini and are not above the legal limit.
Bartender Confirms Justin Timberlake Had Just One Martini at American Hotel Before Arrest (Exclusive) A bartender at the American Hotel in New York told PEOPLE on June 22 that Justin Timberlake had one martini while hanging out at the venue before the singer was arrested and booked on DWI charges on June 18.
The recent Justin Timberlake arrest is not different from that of an ordinary citizen. In this day and age, if you have had anything to drink, you are going to be accused of impairment and arrested. The recent CNN footage shows normal driving behavior.
Much of the supposed evidence consists of officers simply cutting and pasting standard verbiage into their reports, such as "strong odor of alcohol, red bloodshot watery eyes, unsteady on feet, performed poorly on field sobriety tests."
The odor could be equated to having one martini. Red, watery eyes can be attributed to environmental conditions as well as the time of day and are no longer trained as a valid observation for intoxication. Unsteady on feet is often judged when a person is asked to walk like a penguin, which is an abnormal observation.
"Performed poorly" is not a valid description and is contrary to the training in national standards. The battery of procedures has strict guidelines and methods of observation. You do not pass/fail or "perform poorly." This is not a proper or acceptable description. Officers can become so accustomed to conducting DUI/DWI arrests in a memorized fashion that they may take shortcuts.
A skilled DUI defense attorney will highlight these errors and challenge the improper assumptions.

The felony charges against pro golfer Scottie Scheffler were dropped yesterday as they did not even meet the lower standard of probable cause for the arrest.
This situation, while involving a prominent athlete, mirrors a reality faced daily by ordinary citizens. Police often arrest individuals and make accusations that don’t hold up.
Moreover, the actions of the three prosecutors, who challenged changing the arraignment date, seem even more ridiculous now.
In this day and age, the police and prosecution will do as they please unless you have a skilled attorney to dispel the false accusations.

According to preliminary details, he was arrested for not following police instructions regarding traffic flow during a traffic investigation related to a fatal accident. This led to his arrest and felony charges by a police officer whose body camera was not recording the event.
A request to change the arraignment court date for something minor like this is routine and often granted for those who don’t pose a threat to the community. However, three prosecutors are challenging the setting of the date until June 3rd, although no clear reason for the objection was provided. Instead of serving justice, the prosecution is preoccupied with keeping the media attention on themselves. Something that typically results in a dismissal or minor citation is being escalated to a felony level, seemingly for the sake of media exposure for the prosecutors.

Wrongfully arresting and charging sober drivers is an issue that affects the general public and even government officials across the country. What most people don’t realize is that these false arrests don’t come off your record.
In a recent case, a 73-year-old city council member in Oklahoma was accused of being impaired by law enforcement after willingly blowing into the breath test, which displayed triple zeros. Instead of accepting that they had made a mistake, the police required him to conduct field sobriety tests, which are notoriously designed to fail not just for all ages but especially for anyone over 50. This unreliable test was the start of their evidence, followed by a blood draw intended to "catch the bad guy." Police accuse people of crimes they did not commit more often than you would believe. In this case, a woman's car was vandalized by a man who jumped on her windshield, so she contacted the police to file a report. When the police arrived, they accused her of hit-and-run and DUI. Video surveillance would later prove that she had nothing to do with a hit-and-run that occurred that same night. The police involved received an unpaid suspension, and the innocent woman was awarded $200,000 and received an apology.
