"The Tax Court seemed ready to release this much awaited opinion on the valuation of Michael Jackson's right of publicity. Yesterday, Judge Holmes' 275 page opinion was released. As a former IRS Estate Tax Attorney and being acquainted the IRS examiner in this case, I'm especially intrigued. More to follow.

News outlets claim the Estate won. The Estate valued Jackson's right of publicity (name, image, likeness) at a mere $2,000. The Court valued it at $4.1M. It's a victory against the $157M the IRS claimed but an unreliable expert testimony which the Court noted affected the facts and the steep decline in the singer's career and reputation for several years prior to his death impacted the decision.

In 2009, the California and Federal Estate Tax exemption was $3.5M. A net estate over that amount was subject to a maximum of 45% tax rate. The Court's valuation is over 2000 times the estate's reported value. A 2000x increase in value (and tax) due to a successful artist's right of publicity value at death would be no victory. Asset protection planning can make this uncertain valuation ordeal irrelevant."

The purpose and role of a revocable trust is avoiding probate. Probate is a proceeding that occurs typically when an individual passes away. The probate process is something that can be long and costly, and so by having a revocable trust you can avoid the probate process in its entirety. A trust works well, if it is properly created and funded by an expert and experienced estate planning attorney.
