In Morgan and Valverde (2022), the husbandβs failure to file his evidence resulted in the refusal of him cross-examining the respondent. Orders were made for a division of 57.5:42.5 in favour of the appellant. On appeal the husband argued that he was denied natural justice and procedural fairness, however he did not dispute the division of assets. During the original trial the judge told the appellant that he would not be allowed to cross examine thew respondent. The appeal judge concluded that denying the appellant the chance to cross examine the respondent denied him natural justice and was an error of law. It was decided that the error was material, and there was no other option but for the trial to be re heard. β

In Preston & Preston (2022), the Full Court heard the husbandβs appeal from final property orders made by a judge of the Federal Circuit and Family Court of Australia. In the original matter, the judge ordered a division in favor of the husband by treating the husbandβs military pension as a capital asset, however it should have been treated as an income stream. On the contrary the Full Court said βIt was impossible to commute the military pensionβ as neither party sought a superannuation-splitting order in respect of it. The primary judgeβs method caused the military pension to be impermissibly counted twice as a capital asset and as an income stream, this resulted in the original judgment being set aside which was the husbands 58.5 per cent share Following this the final order directed a 50:50 division of the asset pool and any costs from both the husband and wife. β
