Processing times for contributory parent visas have now extended to 12 years or more, leaving many applicants disheartened and questioning the future of their applications. Initially, these visas took between 6 to 12 months to process, which gradually increased to 18 months over the years. By 2021, the estimated processing time was cited as 3 to 5 years, but the influx of applications during the pandemic has further stretched the timeline to over a decade.
Retirees like Marcus, a former judge from the USA, feel misled by these extended wait times. Marcus applied for the 143 visa in December 2021, expecting a 3 to 5-year wait based on official guidelines. However, he later discovered through a FOIA lawsuit that the actual wait time is now over 12 years. This delay has led many to reconsider their options, with some contemplating returning to their home countries or exploring immigration to other nations like the USA, which has a more straightforward process for family reunification. The high cost of the contributory parent visa, which includes an initial fee of $7,000 and an additional $43,600 per parent, further exacerbates the frustration.
Applicants are calling for transparency and honesty from the immigration department and are urging the government to either expedite processing times or offer refunds to those who withdraw their applications.

Significant updates to the Family Visa program mean that immediate family members of Australian citizens and permanent residents can now reunite more quickly. The government’s commitment to family unity is reflected in these changes, which aim to streamline the reunification process and bring loved ones together faster. 💡
This is a wonderful step towards keeping families close despite geographical distances. 👨👩👧👦🌏
In a significant decision, the Administrative Appeals Tribunal (AAT) has ruled in favor of a 485 visa applicant who inadvertently selected the wrong stream on their application. The applicant mistakenly chose the post-study work stream instead of the graduate stream, leading to a refusal by the immigration department. The AAT determined that this error did not mean the applicant applied for the wrong stream, allowing the appeal to succeed.
This case underscores the potential confusion surrounding the recently renamed 485 visa streams by the immigration department, which began on July 1st. Additionally, it has come to light that many 485 visa applicants who applied before the age cap change on July 1st had their visas refused because they lodged their applications on the same day they received their completion letters. Regulations require applications to be submitted the day after the official completion date, a detail not clearly communicated on the department’s website. This lack of clarity has led to numerous refusals, although there may be hope for these applicants at the AAT. It’s advised that affected individuals seek professional advice on whether to appeal.

Victoria and Western Australia have reopened their state sponsorship programs, maintaining the same requirements as the previous financial year. Victoria has received a sponsorship allocation of 5,000 places, with 3,000 allocated to the 190 visa and 2,000 for the 491 visa. Importantly, those who have an existing registration of interest from last financial year can leave it in place for consideration this year, offering continuity and hope for applicants.
The Australian Capital Territory (ACT) has also received its allocation of 1,800 places, with 1,000 designated for the 190 visa and 800 for the 491 visa. As of now, New South Wales has not yet released information regarding their allocation of numbers for state sponsorship. Western Australia has opened its program as well, and it is anticipated that invitations will be sent out soon, with requirements remaining unchanged from the previous year. This includes the consideration of applicants residing in other Australian states.

🗞️ Western Australia has significantly expanded its Designated Area Migration Agreement (DAMA) program, now including Metropolitan Perth as a designated region. This extension provides new opportunities for skilled migrants to find sponsorship and secure employment in a wider range of occupations.
The 482 Visa, a common pathway under DAMA, allows for potential permanent residency after three years in Perth or two years in regional WA. This expansion is expected to attract more skilled workers to the region, helping to address labor shortages and support economic growth. While the DAMA program requires employers to sponsor applicants, the inclusion of more occupations and regions enhances the prospects for those seeking to build their future in Western Australia.

In a significant setback, hundreds of visa applicants are facing rejections for the 491, 190, and 189 visas due to partner skills points issues. Despite assurances from the Department of Home Affairs that marital status changes would not affect their applications, many who married after applying have been caught in a bureaucratic snare.
The current points test, in effect since November 2019, was initially miscommunicated, causing applicants to believe partner points were assessed at the time of invitation, not decision. This oversight has led to widespread confusion and frustration, as applicants like Shamal, an IT professional from Melbourne, find their visa applications at risk of refusal after years of waiting. The department has since updated its webpage, but the damage for many remains.📝
This highlights the need for clear and transparent communication from immigration authorities to prevent future misunderstandings and hardships.

Are you considering transitioning from the Temporary Graduate Visa (subclass 485) to a skilled migration pathway in Australia?
Graduates have several options, including the Skilled Independent Visa (subclass 189) and State Nominated Visa (subclass 190). However, eligibility hinges on meeting specific criteria such as occupation demand and successful skills assessment. This pathway offers a viable route for graduates to build a long-term career in Australia, contributing to its workforce and community.
