Changes include a new definition of "employee", provisions for certain contractors to opt out of the new definition and a new mechanism for contractors to dispute unfair contract terms. It might seem somewhat premature to be thinking about shutdowns over the Christmas period, but legislative changes which commenced last year make it important for employers to prepare well in advance.
The main reason for this is that the ability to direct an employee without sufficient leave to take leave without pay during a shutdown period was (in May 2023) removed from many Awards. As a result, employers should proactively manage annual leave throughout the year to ensure that employees maintain enough leave to cover a proposed future shutdown period. If you think an employee won't have enough annual leave to cover the shutdown period, you may be able to reasonably refuse an annual leave request (for leave to be taken prior to the shutdown) if its approval would result in the employee having an insufficient leave balance to cover the shutdown.

Essentially, this means that employees will have the right to refuse to monitor, read or respond to contact (or attempted contact) from an employer or a third party (such as a client) outside their working hours, unless that refusal is unreasonable. ** Breaking news ** The Fair Work Commission has this morning handed down their latest National Wage Case decision, resulting in the minimum wage increasing 3.75%, to $915.90 a week or $24.10 per hour, from the first full pay in July.
