Lawyers for Human Rights (LHR) hosted a validation workshop on August 27-28, 2024, at the Inter Luxury Hotel in Addis Ababa, focusing on the findings of a stakeholder mapping and needs assessment research. Additionally, a roundtable discussion was held on the transitional justice process.

LHR conducted the mapping and needs assessment research to identify transitional justice (TJ) stakeholders, their needs, and priorities. Following the submission of the final draft of the research by the consultant, Centre of Excellence International Consultant (CEIC), LHR organized a validation workshop to solicit further input on this research output.

More than 40 participants from Tigray, Amhara, Afar, and Addis Ababa attended the validation workshop and roundtable discussion. The participants provided insightful comments and suggestions on the study report, which LHR has considered to further develop and refine the study. The roundtable discussions sensitized participants on transitional justice policy and the roadmap, and discussed the way forward for stakeholder engagement in the national TJ process.

We have invited a distinguished panel of speakers, each bringing a diverse set of expertise to the subject. Our panel includes Mojirayo Oluwatoyin Ogunlana, a digital rights lawyer specializing in legal frameworks at national and regional levels; Brian Tshuma, a Trust and Safety professional lawyer and doctoral researcher at King’s Digital Humanities; and Ameha Mekonnen, the Founding Director of ‘Lawyers for Human Rights’ with extensive experience in defending freedom of expression and contributing to notable human rights organizations. እኛ ሥማችን ከዚህ መግለጫ ግርጌ የተዘረዘርን የኢትዮጵያ ሰብዓዊ መብቶች ተቋማት፣ ዶ/ር ዳንኤል በቀለ የኢትዮጵያ ሰብዓዊ መብቶች ኮሚሽንን (ኢሰመኮን) በዋና ኮሚሽነርነት ባገለገሉበት ጊዜ ላስመዘገቡት የተለየ ውጤት ጥልቅ ምስጋናችንን እና ትልቅ አድናቆታችንን ማቅረብ እንፈልጋለን።

Lawyers for Human Rights signed a grant agreement with the French Embassy in Addis Ababa to provide legal aid services in selected correctional institutions and build the capacity of prison officers on fundamental rights. Following this, a launching event was held at Kaliti Corectional Facility on June 26, 2024 in the presence of the Commissioner General of Federal Prison Administration Commission, Deputy Commissioners and senior leadership of Oromia Prison Administrations Commission. The project will run for one and half years. LHR is delight to be part of this initiative!

Lawyers for Human Rights, in collaboration with the FDRE Ministry of Justice/ የኢ.ፌ.ዲ.ሪ. ፍትሕ ሚኒስቴር, conducted two rounds of training for the Addis Ababa Police from June 18-21, 2024. The focus was on the rights of children in conflict with the law, covering major topics related to international human rights instruments and domestic legislation, protections for children, and challenges in implementing these protections. These trainings also provided a platform for police investigators to discuss the challenges they face in handling cases involving juveniles.

የሕዝብ ተወካዮች ም/ቤት በኢ.ፌ.ዲ.ሪ. ሕገ-መንግስት ለፌደራል መንግስት ተለይተዉ በተሰጡ ጉዳዮች ሕግ የማዉጣት ሥልጣን ተሰጥቶታል፡፡(ኢ.ፌ.ዲ.ሪ.ሕገ-መንግስት አንቀጽ 55)፡፡ ም/ቤቱ ይህንኑ ሓላፊነቱን ሲወጣ እንደማንኛዉም የመንግስት አካል፣ ምናልባትም በበለጠ ትኩረት እና ጥንቃቄ በሕገ-መንግስቱ የተደነገጉትን መርሆች በሙሉ በሚገባ መከተል ይጠበቅበታል፡፡ በመሆኑም ፓርላማዉ አዳዲስ ሕጎችን በሚያወጣበት ጊዜም ሆነ ያሉት እንዲሻሻሉ ረቂቅ ሲቀርብለት አዲስ የሚወጣዉም ይሁን የሚሻሻለዉ ሕግ በሃገራችን ኢትዮጵያ ዉስጥ ዘላቂ ሰላም እንዲሁም ዋስትና ያለዉ ዲሞክራሲ እንዲሰፍን አበርክቶዉ ከፍ ያለ መሆኑን ማረጋገጥ ያለበት ከመሆኑም በላይ ሕገ-መንግስቱ የሃገሪቱ የበላይ ሕግ መሆኑን (ሕገ-መንግስት አንቀጽ 9)፤ ሰብዓዊ መብቶች ከሰዉ ልጅ ተፈጥሮ የሚመነጩ፤ ማይጣሱ እና የማይገፈፉ መሆናቸዉን (ሕገ-መንግስት አንቀጽ10)፤ ይህን ምክር ቤት ጨምሮ በማንኛዉም ደረጃ የሚገኙ የፌደራል መንግስትና የክልል ሕገ አዉጪ፤ ሕግ አስፈፀሚ እና የዳኝነት አካሎች በሕገ-መንግስቱ ምዕራፍ ሦስት ስር የተካተቱትን የሰብዓዊ እና ዲሞክራሲያዊ መብቶች የማክበር እና የማስከበር ግዴታ እንዳለባቸዉ (ሕገ-መንግስት አንቀጽ13) እና የመንግስት አሠራር ለሕዝብ ግልጽ በሆነ መንገድ መከናወን እንዳለበት (ሕገ-መንግስት አንቀጽ 12) ለአፍታም ሊዘነጋ አይገባም፡፡

ከዚህ አንፃር ባለፉት ጥቂት ወራት በሚኒስትሮች ምክር ቤት እየፀደቁ ለሕዝብ ተወካዮች ም/ቤት እየቀረቡ ያሉ አዳዲስ ሕጎች እና ማሻሻያዎች በም/ቤቱ እየተስተናገዱ ያሉበት ሁኔታ ሕጎቹ ይዘዋቸዉ እየመጡ ካሉት አዳዲስ እና አነጋጋሪ ሃሳቦች አንፃር ለዉይይት በቂ ጊዜ በማይሰጥ ጥድፊያ እና ምናልባትም የምክር ቤቱ ዓመታዊ የሥራ ጊዜ ሊጠናቀቅ ጥቂት ቀናት ብቻ የቀሩት መሆኑ ብቻ ታሳቢ ያደረጉ ከመሆናቸዉም በላይ በሕጎቹ ወይም በማሻሻያዎቹ ተካተዉ እየቀረቡ ያሉት አዳዲስ ሃሳቦችም በተለያዩ የሰብዓዊ መብቶች ላይ ጫና የሚያደርጉ፤የአስፈፃሚዉን አካል ሥልጣን በቀላሉ ባልተገባ መንገድ ጥቅም ላይ እንዲዉል ሰፊ እድል በሚሰጥ ደረጃ የሚያጠናክሩ እና በአንፃሩ ደግሞ የሰብዓዊ መብቶች መከበር የመጨረሻዉ ዋስትና እንደሆነ የሚታመነዉን የዳኝነት አካሉን ሚና ዝቅ የሚያደርጉ መስለው ታይተዋል፡፡

እነዚህ ሕጎች ወይም ማሻሻያዎች በዋነኛነት የኢሚግሬሽን እና ዜግነት አገልግሎት አዋጅ ቁጥር 354/1995ን ለማሻሻል የቀረበዉን የማሻሻያ ረቂቅ እና የንብረት ማስመለስ ረቂቅ አዋጁን የሚመለከቱ ሲሆን ሌሎች ለም/ቤቱ እየቀረቡ ያሉ በዜጎች መብቶች ላይ ጫና ሊያደርጉ የሚችሉ አዋጆችም ከመጽደቃቸዉ በፊት በቂ ሕዝባዊ ዉይይት እንዲደረግባቸዉ ሰፊ ዕድል እንዲመቻች ድርጅታችን አጥብቆ ይጠይቃል፡፡

Lawyers for Human Rights, in collaboration with the FDRE Ministry of Justice/ የኢ.ፌ.ዲ.ሪ. ፍትሕ ሚኒስቴር, organized a two-day training for Dire Dawa Police from June 10-11, 2024, on the rights of children in conflict with the law. The training was facilitated by Mr. Mesfin Addise, Consultant and Attorney at Law. It covered major topics such as the rights of children in international human rights instruments and domestic legislation, protections for children in conflict with the law, and challenges in the implementation of these protections.

Elbat Charitable Organization in partnership with LHR Launch project on Improving the rights of Incarcerated in

Addis Ababa, - June 1, 2024 - The Elibat Charitable Organization, in partnership with Lawyers for human rights (LHR), with the support of AFD - Agence Française de Développement, launched a new project aimed at improving the rights and conditions for incarcerated individuals in . This event is the component of the AFD supported Civil Society Innovation Fund project led by LHR intended to support emerging civil society organizations.

The launching event was attended by representatives from the Federal First Instance Court, Federal Police Commission, civil society organizations, the Federal Justice Bureau, Addis Ababa University, and Federal Prisons Commission.

The event was commenced by a welcoming remark from both Elibat Charitable Organization and LHR, followed by a panel discussion on critical issues about the human rights of prisoners, the rule of law, and broader human rights considerations. The panel featured expert speakers who engaged the audience in a robust question-and-answer session.

Observer Status Granted to Lawyers for Human Rights 07/06/2024

Lawyers for Human Rights (LHR) is thrilled to announce that the African Commission on Human and Peoples’ Rights granted us Observer Status during its 79th Ordinary Session held in Banjul, . This status will significantly boost our role in the promotion and protection of human rights both locally and beyond. In particular, it will enable LHR to draw the attention of the Commission to violations of the African Charter on Human and Peoples’ Rights, bring communications on behalf of individuals mainly through strategic human rights litigation, and monitor Ethiopia's compliance with the Charter. The status will also enable LHR to take part in the Commission’s public sessions and engage with the reporting procedures by submitting shadow reports and popularizing concluding observations.

LHR is committed to upholding the responsibilities that come with this status and will diligently work to meet the expectations set by the Commission. We will continue to strive towards our objective of advancing human rights and ensuring justice for all.

የፌደራል የዳኝነት አዋጅ ቁጥር 1233/13 እና የፌደራል ፍ/ቤቶች አዋጅ ቁጥር 1234/13 ን ለማሻሻል እንቅስቃሴ ስለመጀመሩ በፌደራሉ ጠ/ፍ የማህበራዊ ሚዲያ ተዘግቦ ለማየት ተችሏል፡፡

በሁለቱም ሕጎች ላይ የሚደረጉት ማሻሻያዎች የዳኝነት ነፃነትን በማጠናከር እና በሰብዓዊ መብቶች ጥሰት ጉዳት የደረሰባቸዉ ዜጎች በተለይም ሴቶች፤ሕፃናት፤አካል ጉዳተኞች እና ሌሎች ለጥቃት የተጋለጡ የሕብረተሰብ ክፍሎች በቀላሉ መብታቸዉን በፍ/ቤት ለማስከበር እንዲችሉ በቀድሞዉ የጠ/ፍ/ቤቱ አመራር የተወሰዱ እና በሕጎቹ የተካተቱ ታሪካዊ እና ተራማጅ ሃሣቦችን የሚያጠናክሩ እንደሚሆኑ ተስፋ እናደርጋለን፡፡

ድርጅታችን "የሕግ ባለሙያዎች ለሰብዓዊ መብቶች" ሰብአዊ መብቶችን ከማስፋፋት እና ከማስከበር ጋር በተያያዘ ከሚያከናውናቸው በርካታ ተግባራት ጋር በተገናኘ ነፃነቱን በተጠበቀበት ሁኔታ ከሚመለከታቸው መንግስታዊ እና መንግስታዊ ያልሆኑ ድርጅቶች ጋር ተቀራርቦ ለመስራት በሚቻልባቸው ሁኔታዎች ላይ መነጋገርን እንደ ስልት ይጠቀማል።

በዚሁ መሠረት በአገራችን የፍትህ ስርዓት ግንባር ቀደም ሚና ካላቸው መንግስታዊ ተቋማት ውስጥ አንዱ ከሆነው የኢ.ፌ.ዲ.ሪ ፍትህ ሚኒስቴር ጋር ለመነጋገር ያደረግነው ጥረት ተሣክቶ ግንቦት 22 ቀን 2016 ዓ.ም. ከክቡር አቶ በላይሁን ይርጋ፤ የመንግስት ሕግና ፍትህ አገልግሎት ሚኒስቴር ዲኤታ እና የስራ ባልደረቦቻቸው ጋር የጋራ በሆኑ ጉዳዮች ላይ እጅግ ጠቃሚ ውይይት አድርገናል።

በዕለቱ ከተነሱት አጀንዳዎች ውስጥ ድርጅታችን፤ ፍ/ቤቶች ሰብአዊ መብቶችን በማስከበር ረገድ ያላቸውን አበርክቶ ለማሳደግ እና የሰብአዊ መብት ጥሰት ፈፅሞ ያለመጠየቅ ባሕልን (impunity) በማስቀረት ተጠያቂነትን ለማስፈን ዓይነተኛ መሣሪያ የሆነውን ለሕዝብ ጥቅም የሚደረግ የሰብአዊ መብቶች ሙግት (Strategic Human Rights Litigation) በማስተዋወቅ እና ተግባራዊ በማድረግ ረገድ፣ እንዲሁም በዓይነቱ የመጀመሪያ ሊባል በሚቻለው እና ከክስ በፊት (በወንጀል ምርመራ ደረጃ) የነፃ የሕግ ድጋፍ አገልግሎትን ለመስጠት እያደረገ ባለው እንቅስቃሴ በተለይ በአዲስ አበባ ላይ እያጋጠሙ ባሉ ችግሮች ዙሪያ ለመወያየት የተቻለ ሲሆን ለችግሮቹ መፍትሔ ይሆናሉ የተባሉ ጉዳዮችንም ለማየት ተችሏል።

በመሆኑም ውይይቱ እንዲሣካ ከተጣበበ የሥራ ግዜያቸው ቀንሰው በራቸውን ክፍት ላደረጉልን ለክቡር አቶ በላይሁን ይርጋ እና የሥራ ባለደረቦቻቸው ያለንን አክብሮት ለመግለፅ እንወዳለን።

The event facilitated a rich and dynamic exchange of perspectives. Participants engaged in lively discussions, sharing insights and experiences, and identifying key areas for potential collaboration. This collaborative effort is expected to enhance the effectiveness of strategic human rights litigation in Ethiopia, ultimately contributing to the promotion and protection of human rights in the country. The consultation has laid the foundation for the establishment of a consortium of Ethiopian civil society organizations for strategic human rights litigation.

This initiative underscores the importance of collaboration among the different civil society organizations and other stakeholders in advancing strategic human rights litigation. By working together, these organizations can leverage their respective strengths and resources to achieve common goals more effectively. Lawyers for Human Rights (LHR), in collaboration with the Konrad-Adenauer-Stiftung, conducted a two-day training session for leadership and investigators from the Police Commissions on at the Elilly International Hotel in Addis Ababa, held from April 18-19, 2024. The training encompassed various subjects including fundamental rights concepts, the rights of individuals under police suspicion or detention, and the obligations of law enforcement in upholding the fundamental rights of those accused of crimes. This training initiative is part of a broader series of capacity-building endeavors aimed at enhancing the understanding of among law enforcement agencies.

LHR, in collaboration with the Konrad-Adenauer-Stiftung, organized a validation workshop on the assessment conducted on the Compatibility of Procedural Laws of to Strategic Human Rights Litigation on 16 April 2024 at Check-Inn Hotel _Ababa. The workshop aimed to enrich the findings of the assessment and to call for actions from stakeholders to create a conducive environment for SHRL, which seeks to bring about broader policy change, legal reform, institutional accountability, and behavioral change.

The workshop began with a welcoming speech by Mr. Ameha Mekonnen, the Executive Director of LHR, followed by an opening remark by Mr. , Country Director Ethiopia & Liaison Office AU. Deputy Chief Commissioner _Messele also gave a keynote speech on the role of National Human Rights Institutions in Supporting Strategic Human Rights Litigations.

The workshop was based on an assessment conducted on the Compatibility of Procedural Laws of Ethiopia to Strategic Human Rights Litigation, which was presented by Dr. Mesenbet Assefa, Assistant Professor of Law and consultant attorney. The discussion on the assessment started with comments and reflections from Dr. Menberetsehai Tadesse, former Deputy Chief Justice of the Supreme Court. Finally, the workshop was closed by Mr. Ameha Mekonnen, who made remarks on the way forward.

ድርጅታችን 'የህግ ባለሙያዎች ለሰብአዊ መብቶች' በአገራችን ተግባራዊ ይደረጋል በሚል እንቅስቃሴ የተደረገበት ካለው የሽግግር ፍትህ ጋር በተያያዘ በፖሊሲ ሰነድ ዝግጅቱ ላይ በተናጠል እና ከሌሎች ሲቪል ማህበራት ጋር በጋራ በመሆን ምክረ ሃሳቦችን በማቅረብ በንቃት ሲሳተፍ የቆይ ከመሆኑም በላይ ለተግባራዊነቱም መደላደል የሚሆኑ ስራዎችን በመስራት ላይ ይገኛል። አሁንም የሽግግር ፍትህ ፖሊሲ ሰነዱ በቅርቡ ፀድቆ ስራ ላይ ሊውል እንደሆነ እየተነገረ ባለበት ደረጃ ድርጅታችን ከሌሎች ሲቪል ማህበራት ጋር በጋራ በመሆን የፖሊሲ ሰነዱ ሊኖረው በሚገባው የመጨረሻ ይዘትና ቅርፅ ላይ አስተያየታችንን እንደሚከተለው አቅርበናል

Our organization, Lawyers for Human Rights, has been actively engaged by itself and in collaboration with other CSOs in the various consultation forums of the transitional justice policy alternatives and it has begun executing foundational activities that would support the process. As we are approaching to the adoption of the policy by the government, we have joined with other civil society organizations to present our collective views on the content and structure of the first draft policy on transitional justice.
