Army (Amendment) Act 2023 and Official Secret (Amendment) Act 2023 would likely be declared null and void. Article 75 (1) does stipulate either refusal or passage of the bill by the President within 10 days. However, Art 75 (1) (a) or (b) do not provide the consequences of inaction by the President. Art 75 (2) provides for deemed assent in case bill was returned by the President and passed again during joint sitting of the Parliament. Now this is the classic example of poor draftsmanship of Article 75 of the Constitution. Question arises if Art 75(2) can be stretched and deemed to have a combined effect in both cases: I) inaction; II) and return? Far fetched. These Acts (or Bills if I may say) would not survive.
